Can I rent a unit if there was a tenancy contract that expired but is not canceled yet?
Dangling Ejari, a red flag?
I am interested in renting a unit, but after investigation, it turns out the current Ejari is expired but not canceled.
If my understanding is correct, a tenant can not register Ejari if the previous one is not canceled, putting the new tenant in a sort of limbo.
Is that correct?
Should I consider this a red flag or a simple administrative step easy to fix?
In order to register a new Ejari, the previous one must be cancelled.
According to RERA regulations, only one Ejari registration can be active for a property at a time.
If the previous tenant's Ejari hasn't been canceled, even if it's expired, it will block you from registering a new Ejari for that unit.
You may approach the landlord and explain the situation and emphasize the importance of canceling the old Ejari before you move in. They are responsible for initiating the cancellation.
