س: سيدي العزيز، أنا (س) من أبو ظبي. كنت أعمل في شركة منطقة حرة لمدة الثلاث سنوات الماضية في دبي. لدى شركتنا عملاء في كلٍ من أبو ظبي ودبي، وتقوم بتقديم خدمات الفوترة الطبية للمستشفيات والمراكز الطبية. كنت أعمل مع أحد عملاء الشركة وهي مستشفى حكومية في أبو ظبي (برجاء ملاحظة أن الحكومة قامت بإزالة شركتنا في سبتمبر). إنني قلق، وذلك لأن الشركة مهتمة بي لأن أعمل موظف لديهم. ولكن قد قمت بالفعل بتوقيع عقد محدد المدة مع شركتي، والذي يتضمن "اتفاقية عدم منافسة وعدم السعي للعمل عند العملاء أو المنافسين". ينص عقدي على أنه لا يمكنني الالتحاق بالعمل عند عملاء الشركة أو منافسيها لمدة 24 شهرًا بعد انتهاء تأشيرتي أو إنهاء خدمتي. إذا قمت بخرق هذا القانون، فسيتخذون إجراءات قانونية ضدي وسيطالبونني بالتعويض (قانون رقم 8 لسنة 1980 الإماراتي، وقانون رقم 5 لسنة 1985 لدبي). تنتهي تأشيرتي في 25 أغسطس، وأود الالتحاق بالعمل هناك. هل يمكنني الالتحاق للعمل بمستشفى أبو ظبي الحكومي أم لا؟ هل سأواجه أي مشاكل قانونية من قبل شركتي؟ أسئلة وأجوبة

Q: My husband was awarded shares in the company he works for. Now he is leaving and wants to sell them and the company refuses to acknowledge the fact that he holds shares even though it clearly states that he does in the `Articles of Association`. Consequences of increased area of property on handover
Q: I invested in a Dubai property in 2007. It was completed in 2016. In my handover notice was included a size increase letter which says my property size has increased by 50% and I now need to pay an extra 463,000 AED. Under Executive Council Resolution No. (6) of 2010 Approving the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register: "Any area in excess of the net area of the sold Real Property Unit may not be taken into consideration. Unless otherwise agreed, the developer may not claim the value of such extra area." The developer is saying because I agreed to pay for any increase in my SPA which I signed in 2007 I have to pay for the increase. I am saying since the law came out in 2008 and decree 6 came in 2010 they would have to agree the increase with me again. Can you please advise. أسئلة وأجوبة

Dishonoured cheques and breach of contract
Q: A Company had issued us several cheques amounting to nearly 600,000 AED. All the cheques had bounced, and we lodged a complaint with the police station. The police after calling for the bank documents and details from the defaulter`s bank issued a travel ban. All efforts of the police to trace the defaulter or contact over the phone have been futile. The police have now forwarded the case to the court and asked me to keep track of the dates on the portal. The cheques were signed by the Managing Director of the company. It is important to note that the defaulting Company had violated several terms in the contract, resulting in fraud and criminal conspiracy and breach of trust. Please advise what will be the consequences the defaulter may have to face and how should we go about it. أسئلة وأجوبة

كيف يمكنني رفع حظر العمل في الإمارات
س: كنت أعمل في شركة بوتيك 1، شركة ذات مسؤولية محدودة. تركت الشركة في شهر أكتوبر من العام 2015 بعد العمل معهم لمدة 11 شهرًا، لذا حصلت على حظر عمل لمدة سنة. ثم التحقت بشركة أخرى في المنطقة الحرة، وتمت إجراءات تأشيرتي بدون مواجهة أي مشاكل في أكتوبر 2015. إنني الآن مع هذه الشركة منذ سنة وتسعة أشهر، والآن لدي عرض عمل من شركة لاندمارك، كمدير للتسويق بالشركة، وهي شركة ذات مسؤولية محدودة. لذلك قمت بإلغاء تأشيرتي وقدمت على تأشيرة جديدة معهم، ولكن تم الرفض بسبب أنه لدي منع عمل لمدة سنة. وُضع الحظر من العمل من قبل جهة العمل القديمة بوتيك 1 ( كان يجب أن ينتهي المنع من العمل السنة الماضية)، ولكن نظرًا لأنني لم أغادر البلد وغيرت التأشيرة الخاصة بي من داخل الإمارات، فإن منع العمل لم يبدأ من الأساس. لقد قدمت طلبًا في "تسهيل"، ولكني لا أعتقد أن ذلك سيساعد في شيء. لدي كل ما يلزم لرفع هذا الحظر. عقد العمل براتب يزيد كثيرًا عن 12000 درهم إماراتي، شهادة موثقة بدرجة البكالوريوس، وإذا لزم الأمر، يمكنني الحصول على شهادة عدم ممانعة من بوتيك 1، حيث قد مرت سنتين تقريبًا منذ أن تركتهم. أريد المساعدة العاجلة. أسئلة وأجوبة

Revocation of share transfer agreement by one of the shareholders
Q: I hold a 25% stake in a Free Zone company in Dubai, with my business partner holding a 75% share and therefore being the majority shareholder. In April 2017, there was an agreement between myself and my partner, in which he agreed to transfer all of his shares to me. Upon this agreement, we both signed and stamped a request for transfer of shares document as well as a shareholders resolution. These documents were then submitted to the Free Zone Authority but then were subsequently withdrawn without my knowledge. As far as I was aware the documents were still being processed and I only found out about the withdrawal of the documents when I followed up with the Free Zone Authority. The Free Zone Authority has since acknowledged that they should not have returned the documents and are trying to mediate between myself and my business partner to submit the documents again but he is refusing to do so. I want to know what legal action I can take against my partner for his actions. أسئلة وأجوبة

Protection of investment in LLC business
Q: I did partnership in LLC business with one Indian last year. Recently I asked him to return my investment as he was not giving any reward of my investment. He agreed to return it. But now he is absconding because he owes some amount to an old partner who filed a police case against him. What should I do now to protect my investment or to avoid further loss?
