بنود عدم المنافسة في عقد العمل
س: سيدي العزيز، أنا (س) من أبو ظبي. كنت أعمل في شركة منطقة حرة لمدة الثلاث سنوات الماضية في دبي. لدى شركتنا عملاء في كلٍ من أبو ظبي ودبي، وتقوم بتقديم خدمات الفوترة الطبية للمستشفيات والمراكز الطبية. كنت أعمل مع أحد عملاء الشركة وهي مستشفى حكومية في أبو ظبي (برجاء ملاحظة أن الحكومة قامت بإزالة شركتنا في سبتمبر). إنني قلق، وذلك لأن الشركة مهتمة بي لأن أعمل موظف لديهم. ولكن قد قمت بالفعل بتوقيع عقد محدد المدة مع شركتي، والذي يتضمن "اتفاقية عدم منافسة وعدم السعي للعمل عند العملاء أو المنافسين". ينص عقدي على أنه لا يمكنني الالتحاق بالعمل عند عملاء الشركة أو منافسيها لمدة 24 شهرًا بعد انتهاء تأشيرتي أو إنهاء خدمتي. إذا قمت بخرق هذا القانون، فسيتخذون إجراءات قانونية ضدي وسيطالبونني بالتعويض (قانون رقم 8 لسنة 1980 الإماراتي، وقانون رقم 5 لسنة 1985 لدبي). تنتهي تأشيرتي في 25 أغسطس، وأود الالتحاق بالعمل هناك. هل يمكنني الالتحاق للعمل بمستشفى أبو ظبي الحكومي أم لا؟ هل سأواجه أي مشاكل قانونية من قبل شركتي؟

Contractual rights of a former employee
Q: I resigned from my position in October 2016. The company is threatening legal action for soliciting employees and starting my own business to compete with them. All false allegations. I have responded to their lawyers already but I wanted to know if I have a case against them as not all my contractual rights were honoured.

حقوق الموظف الذي تنهي الشركة تعاقده في فترة الاختبار
س: أعمل لدى شركة بعقد غير محدد المدة وهذا هو الشهر الثالث لي في هذه الوظيفة، وسؤالي هو إذا قررت الشركة إنهاء عقدي لأن آدائي لا يرقى إلى المستوى المطلوب مثلًا، فهل عليّ رد ثمن التأشيرة وتذكرة الطيران والتدريب للشركة؟ مع العلم أنه خلال عملية التوظيف، جعلتني الشركة أوقع على إقرار بأنني إذا تركت العمل قبل 3 سنوات، سوف يتوجب عليّ رد ثمن التأشيرة وتذكرة الطيران والتدريب. أحتاج لنصيحتك.2017/07/26

What to do if you have credit card debts
Q: Hi, I am staying in Abu Dhabi with my husband & 7 years old daughter. My husband was working in a big construction company from the year 1996. In October 2015, he got terminated due to which he went in depression. He got another job but due to depression, he was not going to work regularly. The company terminated him. He doesn`t have a job for 2 months & he is not in the position to look for the job as he has depression again. He was having 3 credit cards. During his first job, he paid regularly without any delays. But after this new job, he didn`t pay on time & even for 2 cards we were unable to pay for around 1 year. For the third card after checking with the bank, we had made installments but now for past 3 months, we didn`t pay for it. I really don`t know what to do. I am also working but my salary is good enough for the rent only. Nowadays, our friends are helping us for the daily needs even. Letter required for property loan clearance
Q: I own an apartment in Dubai and on the Title Deed I have my name and that of my daughter who is a minor. I have approached a bank for an equity release against the apt and the bank has asked me to get a court permission allowing me to get the loan since there is a minor. I have approached the personal status court and the judge asked me to prepare a personal statement of my position, etc and to include the reason why I need the money and what I plan to do with the money. On the personal statement I put “The purpose that I am applying for this loan is because I would like to use the money towards the continued education of my daughter as she attends university in the United States to obtain a Bachelor’s degree which takes 4 years and part of the application process is to show proof of funds in order to pay for university as a pre-requisite in the application process.” My question is my reasoning ok for the Personal Status Court or should I put something else on my personal statement?2017/07/23

كيفية تمديد عقد الإيجار لبضعة أشهر
