Consequences of filing a criminal case against a debtor by the bank
Q: Hi, I have just found out I have a police case filed by my bank on a credit card payment. I have a credit card with 25k limit and could not do minimum payments for 1 year (due to job loss), nevertheless, the bank filed a case against me for 190k. I do not understand on what ground and would like to know what to do. As well, how can I find out if I have a travel ban as I would rather try and solve the situation remotely from home than be concerned that I will be jailed here? Your advice is appreciated.

Issue with rental property
Q: I left my room 9 months ago and handed over the key to real estate agency. My stay period was only 2 months and 13 days. Now real estate agency is calling me and saying that I have to pay more money, otherwise, they will go to court... But the time I handed over the key, they did not return my security deposit and 20 days advance rent. Now after 9 months they are calling me...2017/07/20

Consequences of increased area of property on handover
Q: I invested in a Dubai property in 2007. It was completed in 2016. In my handover notice was included a size increase letter which says my property size has increased by 50% and I now need to pay an extra 463,000 AED. Under Executive Council Resolution No. (6) of 2010 Approving the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register: "Any area in excess of the net area of the sold Real Property Unit may not be taken into consideration. Unless otherwise agreed, the developer may not claim the value of such extra area." The developer is saying because I agreed to pay for any increase in my SPA which I signed in 2007 I have to pay for the increase. I am saying since the law came out in 2008 and decree 6 came in 2010 they would have to agree the increase with me again. Can you please advise.

Bank loan issue
Q: I was working for Etihad Airways as cabin crew. I got fired last March so I couldn`t pay my loan to the bank. I tried to find a job but I was not lucky. However, when I came back home, a hotel in Dubai sent me an offer letter. But the bank sent me a notice about legal action. If I don`t pay the last 4 months I will be facing a big problem with the court. What should I do? Please advise.2017/07/18

ماذا تفعل إذا لم يقم صاحب العمل بدفع الراتب
س: مرحبًا سيدي، أعمل مهندس اتصالات في الإمارات ( لكن مسمى الوظيفة في التأشيرة هو صراف إلكتروني ). لم تحصل شركتي على أي مشروع منذ فبراير 2017. طلبوا مني أن آخذ عطلة في فبراير 2017، وعلى الرغم من هذا لم يحصلوا على أي مشروع. عدت في 13 يوليو 2017 دون إخبارهم. لا يدفعون راتبي الآن بسبب عدم وجود عمل، لذا طلبت منهم شهادة عدم ممانعة حتى يمكنني العثور على وظيفة أخرى، والآن يطلبون مصاريف التأشيرة. ما الذي ينبغي علي فعله الآن؟ تاريخ إصدار التأشيرة: يونيو 2016 ( تأشيرة عمل لمدة سنتين ) أرجو أن تقترح علي ماذا أفعل.2017/07/18

Do I have a travel ban if I was fined for bounced cheque by the public prosecutor?
Q: I lost my job and could not pay the EMI`s since Jan 2017 till now against a personal loan of AED 316,000. The bank bounced my cheque in March 2017 and I was fined Dhs 15,000 by the public prosecutor. Do I have a travel ban or not by the bank? The bank is calling me every day for paying the loan even after the police case. I am still jobless.2017/07/18

هل يمكن تبديل الحكم بالسجن إلى حكم بالغرامة إذا كان المتهم خارج الإمارات؟
س: عزيزي السيد / خالد، لقد كنت أعمل وأعيش في الإمارات العربية المتحدة منذ 10 سنوات وكنت مديونًا ببعض بطاقات الائتمان وبقرض. جئت إلى باكستان في العام الماضي ولم أعد، حيث تم إنهاء عقد عملي خلال عطلتي. بدأت الآن في تسوية مع البنوك وحصلت على خصم جيد ووافقت على التسوية. تبقت بعض القضايا القليلة والتي أخطط لدفع الغرامات فيها في المحكمة. قضيتين من تلك القضايا حكم فيها بالسجن، حكم بالسجن لمدة شهر في قضية مستحقات بطاقة ائتمان بقيمة 16000 درهم إماراتي، والسجن لمدة شهرين في قضية أخرى عن مستحقات بطاقة ائتمان أيضًا بقيمة 31000 درهم إماراتي. برجاء النصح، هل يمكن أن يتم تبديل الحكم إلى غرامات أيضًا؟ ما الذي ينبغي علي فعله في هذا الموقف حيث أنني خارج الإمارات وعلي حكم بالسجن فيها؟ شكرًا لك.2017/07/18

Refund of a deposit paid by the buyer of a real estate property
Q: Hi, I had signed an MOU to buy an apartment. I had the following clause in the MOU: "This sale purchase contract is subject to the final approval from the Buyers Banks" My mortgage has been rejected by one bank. While I was processing my mortgage with another bank the MOU expired and the seller is not willing to extend the MOU. Can I claim my deposit check back from the agent? Thanks, Dinesh2017/07/18

Dishonoured cheques and breach of contract
Q: A Company had issued us several cheques amounting to nearly 600,000 AED. All the cheques had bounced, and we lodged a complaint with the police station. The police after calling for the bank documents and details from the defaulter`s bank issued a travel ban. All efforts of the police to trace the defaulter or contact over the phone have been futile. The police have now forwarded the case to the court and asked me to keep track of the dates on the portal. The cheques were signed by the Managing Director of the company. It is important to note that the defaulting Company had violated several terms in the contract, resulting in fraud and criminal conspiracy and breach of trust. Please advise what will be the consequences the defaulter may have to face and how should we go about it.2017/07/18

What to do if you have a police case due to an unpaid bank loan
Q: Hello Sirs, I badly need help. I was terminated from work due to a bad market situation to cut the cost. They let me use the company visa until I get a permanent job but the market situation is really bad. They informed me that the management has decided to cancel all pending visas of terminated people including mine. When my passport and documents were submitted to JAFZA, the cancellation was rejected due to a police case due to non-payment of a bank loan. I am so afraid they will catch me and put me directly in jail... If so, how can I start again and look for a new job to repay my loans? Please, I beg you help me... Do I need to cancel visa with my employer in Kuwait to get UAE employment visa?
Q: I was working in Kuwait as an electrical QC inspector. While working in Kuwait I got an offer from an Abu Dhabi company for ADCO project. They told me that I have to come to India for joining ADCO project in Abu Dhabi. Then, I moved to India and I received an offer letter from Abu Dhabi company. They offered me almost 5600 AED/month. I accepted the offer letter and put my thumb impression and signature on offer letter and sent it to my employer in Abu Dhabi. They told me that they are going to apply for a visa for me. But today they called me that my visa application rejected. They told me that it`s rejected perhaps of my active visa in Kuwait because I didn`t cancel visa of my previous employer but my visa is going to be expired in next month on 24th August. Can you tell me the reason for my visa rejection and what should I do? Thanks2017/07/17

Filing case for maintenance against husband in the UAE
Q: Dear, I am writing this on behalf of my sister in law: "I married this guy almost 15 years ago. He left for a job in the UAE. Now he rarely visits me in Pakistan in years. He also got married to some other Pakistani girl in the UAE. Meanwhile, he is forcing me to live in Pakistan in his own home and does not directly give me the money to take care of myself and my children. He sends the amount to his father and he then assesses my needs and gives me a calculated amount. Is there any law in the UAE through which I can bind him to pay me my expenses or I can take khulaa (separation)?" P.S. The lady is really heartbroken and desperate.
