What to do to recover money paid for real estate agency after revoking MOU?
Q: Dear Sir, Please be informed that I contacted one of the real estate agents in Sep 2022 for a purchase of an apartment in Abu Dhabi. MOU signed with seller/agents in Oct 2022. The subject apartment was under lease and a tenant was staying there. I contacted my bank for a mortgage and the bank requested access permission for valuation. However, the agents informed me that the tenant is out of the country. And later once the tenant was back in the country, I requested agents for further permission. After multiple tries, the tenant provided the bank with access for valuation. I had no direct contact with the owner/seller. I paid the bank valuation fee. Once approval came from the bank, I informed the agent. I got a reply that the seller does not wish to proceed with the MOU. Then requested agents to return the agency commission fee, which I paid at the time of signing the MOU. Ever since I am behind the agency to return my amount. However, agents have not yet returned the amount to date. Appreciate your necessary legal advice. Thank you. Regards T.2023/04/06

Q: Hi, I was trying to check the RERA/rental increase for JVC. According to the rental index results, it stated that it is not applicable to hotels and hotel apartments. What is applicable for such residential complexes, and how can I calculate it? Additionally, where is it specified that the landlord needs to give 90 days` notice in case of a rent increase?

The process of a labor case hearing if the employer does not attend
Q: Good day everyone! Can anyone help me to find answers to some questions? Thanks in advance. Since I am new in Dubai Courts, I had a couple of questions. I filed a labor case in MOHRE regarding non-payment of gratuity. MOHRE accepted my complaint and they refer me to the court. I filed a case in court and I am waiting for my case number and date of hearing. Now, my questions are: 1. What would happen on the first hearing? 2. When is the second hearing? 3. How long does a labor case take in court? 4. Can I claim compensation if my employer appeals in court? 5. What will happen if the employer did not attend the 1st hearing? Thank you in advance.

What happens when I give my tenant an eviction notice mid tenancy contract?
Q: I gave my tenant a notarised eviction notice to vacate my apartment as I want to sell it. I handed the notice in December 2022, and the current tenancy agreement expires in April 2023. The tenant has raised a case in RDC seeking a full 12-month contract renewal till April 2024, which will exceed the notice period. Being a non-UAE resident and not having a unified ID #, I cannot submit my response and have a video hearing soon. What can I do?

Fixing a persistent ceiling leak in an apartment with minimal hassle
Q: Dear Community, I am seeking your support and guidance regarding an issue in my 2-bedroom apartment in Sharjah. I bought an apartment and the previous owner served eviction notice. Do I need to serve a new one?
Q: I recently bought an apartment with an existing tenant. The previous owner served the tenant an eviction notice via Dubai Courts. By using this notice, can I evict the tenant or not? The eviction period ends on September 2023 and the current contract ends on April 2023. If I can evict the existing tenant, how should I prepare a new contract? Is it enough to prepare a 5-month contract and refer to the eviction notice in additional terms?

Is there any law regarding the nuisance caused by neighbors in the resting time?

What happens when the property is sold mid-lease?
Q: Dear Sir/Madam, Does the existing tenancy contract between the tenant and the previous owner remain in force even after the new landlord has purchased the property in the middle of an ongoing lease? And when should a new tenancy contract be made? Should it be made immediately after the property has been sold, or at the end of the ongoing tenancy contract signed between the previous owner of the property and the tenant? Also, does a new contract have to be in place for the tenant to exchange the cheques, or does the existing tenancy contract with the previous owner remain valid for the purpose of exchanging the cheques?

Q: We are an Abu Dhabi foreign branch office of Bahrain and Bahrain is owned by the UK. We have successfully registered our logo with MOE using our Abu Dhabi trade license. However, our UK office said that all IP should be under the name of the UK head office. The UK wants to assign the trademark/logo to the UK head office. Can we assign/transfer the right to the UK?
