A woman wants to move out of abusive home. What are her legal options?
Q: Dear Sir/Madam, I am an Arab expatriate woman living in the UAE, sponsored by my company on a work visa. I live with my oppressive family and I want to move out and live independently. Can my father legally attempt to force me to come back? Does the law protect me from potential abuse from my parents following this decision? Can they file a missing persons report, and what are the consequences of that? Can I file a restraining order, and does that guarantee they won`t approach me? I would really appreciate your help. My living situation is unbearable and I need to leave this household for the sake of my mental and physical wellbeing.

I bought a property and the previous owner did not send an eviction notice to the tenant. What to do?
Q: I just happen to buy a property and sign the papers today. The property is occupied till 30 June as the tenancy also expires on the same day. I was not informed by the previous owner that the tenants are going to renew the contract. They did not send an email to the previous owner of their intention to renew the contract. I am a female, I have not renewed my old contract and have no place else to shift. Can I get the tenant to vacate and move to the property? Please guide.

A real estate company refuses to refund booking fee, what to do?
Q: Hi guys, Please help me! I am a young lady just trying to make ends meet, but I was scammed. I saw a flat that I wanted to rent, so I contacted the real estate company and went for a viewing. I paid an AED 8,190 booking fee, which was refundable if they did not honor the deal. The day to sign the contract came, but I was given excuses. I requested my refund and was given a check that the bank rejected. I reported this to Dubai Land, and they contacted the company to pay me back. I received AED 4,000, but they still owe me AED 4,190, which I really need back. Dubai Land said I must contact a legal advisor, but I cannot afford one. Please advise me on how to go about this situation. I would appreciate any help. These guys have since resorted to ignoring me. I have a copy of the receipt, the check, and the emails to support all of this.2023/05/31

كيفية إلغاء إبعاد إداري
س: السلام عليكم، عملت مدرسًا في الإمارات لمدة 33 سنة ولم تُسجَّل ضدي أي مخالفة وسيرتي الذاتية في الدولة ناصعة. فوجئت بقرار إبعادي إداريًا بدون أن يبدي موظف الجوازات أي سبب. أبلغني أني مُبعد إداريًا لمدة عام وأنه يمكنني تقديم استرحام وأخذوا لي بصمة العين. حتى الآن لم يردوا على طلب الاسترحام ومكتوب على الموقع "تحت الإجراء" رغم أنه مر على تقديمه 4 أشهر ونصف. أخشى أن يكون إبعادًا نهائيًا لأنهم أخذوا بصمة العين. سؤالي: إذا كان إبعادًا نهائيًا، فمَ الذي يمنع موظف الجوازات من إبلاغي؟ بمَ تنصحوني؟

ما الفرق بين طلب فتح عريضة وطلب الإذن لفتح بلاغ؟
س: السلام عليكم، الأساتذة الأفاضل، يُرجى توضيح الفرق بين طلب فتح عريضة وطلب الإذن لفتح بلاغ حيث كلاهما يُقدَّم للنيابة ولهما نفس التفسير القانوني حسب ما فهمت، ولكن هناك اختلاف في الرسوم؛ فالعريضة (٢٠ درهمًا)، والإذن لفتح بلاغ (١٠٠ درهم). كما أن مدة إتمام المعاملة هي ٢٤ ساعة للعريضة ويومي عمل للإذن بفتح بلاغ. هل يجوز تقديم طلب فتح عريضة والإذن بفتح بلاغ لنفس الموضوع في نفس الوقت؟

How to protect yourself when signing a tenancy contract of a warehouse?
Q: Dear Sir/Madam, We are in the process of setting up our company in the UAE. We have found a warehouse that fits our requirements and we have paid the security deposit and the agency fees. We would like to confirm some points before signing the contract: - Notice period: The owner said that we should inform him one month in advance if we want to leave and exit the contract. Is there a clause in the DREC contract that states this? Are there any penalty fees? How can we avoid any problems with this? - No Objection Certificate (NOC): The owner promised to give us an NOC after the contract is signed to allow us to upgrade the power and install air conditioning. How can we make sure that this happens? Should we have him include this in the contract terms? In general, can we trust their promises or should we get a letter before signing the contract? Note that they are refusing to give us an NOC and we have been told that we took too long to finalize the contract. Thank you for your attention to this matter!

Unjustified rent increase: What are my options?
Q: Dear Sir/Madam, I am writing to seek your advice on a matter related to my tenancy. I am facing some concerns and uncertainties. Recently, my landlord proposed an unjustified rent increase of 9,000 AED. The RERA calculator clearly indicates that the increase should be only 3,000 AED. There was mention of going through the Rent Valuation process, but since our last communication, there has been no further response from either the landlord or the real estate agent. My concern is that my tenancy contract is due to expire in just a couple of days, and I have not received any communication regarding the renewal process. I had previously sent an email inquiring about the rent contract and the collection of rental cheques, but unfortunately, there has been complete silence in response.
