س: مرحبًا،
أحتاج إلى المشورة بشأن مستحقات نهاية الخدمة الخاصة بي. أعمل لدى صاحب عمل في إمارة أبو ظبي منذ عامين ونصف.
لقد استقلت مؤخرًا من منصبي وأكملت بنجاح فترة الإشعار التي تبلغ مدتها شهرين في 14 أغسطس. منذ ذلك الحين، لم يدفع صاحب العمل مستحقاتي التي تم الاتفاق عليها في آخر يوم عمل لي.
في الواقع، إنهم يجبروني على توقيع وثائق الإلغاء قبل تسوية أي مستحقات، لكنني رفضت ذلك حيث أن وثائق الإلغاء تنص بوضوح على "أنني أقر بأنني استلمت جميع مستحقاتي".
لقد طلبت منهم السداد عدة مرات عبر البريد الإلكتروني وعن طريق الهاتف ولكنهم ما زالوا يقدمون أعذارًا غير مُرضية ويقومون بتأخيرات غير ضرورية.
هل يمكنك أن تقدم لي المشورة بشأن كيفية معالجة هذا الوضع لأنني بحاجة ماسة إلى العودة إلى بلدي؟
أريد أن أغادر في ظروف جيدة دون أي خلافات في هذه المرحلة.

التوقيع على مستند إلغاء التأشيرة دون الحصول على مستحقات العمل
س: هل يجب على الموظف توقيع أي مستند مع صاحب العمل لبدء إجراءات إلغاء التأشيرة بعد الاستقالة وقبل آخر يوم عمل؟
يطلب مني صاحب العمل التوقيع على استمارة "وزارة الموارد البشرية والتوطين الإماراتية لإلغاء تصريح العمل إلكترونيًا"، حيث تمت طباعة وكتابة جميع بياناتي، "أشهد بأنني تلقيت كافة مستحقاتي بالكامل ... توقيع الموظف".
تنتهي فترة الإشعار الخاصة بي في 29 أغسطس ولا يزال يتعين عليهم دفع مكافأة نهاية الخدمة ... وما إلى ذلك، وأنا أعمل بموجب عقد عمل غير محدد المدة ويطلب مني صاحب العمل التوقيع على هذه الوثيقة موضحًا أنه يجب علي التوقيع عليها لبدء إجراءات إلغاء التأشيرة.
لكنني غير متأكد من مدى صحة التوقيع على هذا المستند لأنني لم أتسلم راتبي حتى الآن ولكن المستند يشير إلى غير ذلك.

After the cancellation from the labor department, can I file a complaint against my employer for not paying me my salary and end-of-service benefits?

Am I obliged to sign the visa cancellation letter before receiving my end-of-service benifits (EOSB)?
Q: I joined the company (Media City free zone) on December 4th, 2023, and resigned on February 15th, 2025. We agreed that my last working day would be April 15, 2025, as my contract specifies a two-month notice period.
Yesterday, March 25, 2025, I received an email from the HR department requesting that I sign the visa cancellation letter today or before receiving my end-of-service payment and final salary.
I have researched the DMCC and UAE laws and found that I should not sign any visa cancellation letter until I have received my payment.
I was provided with a final settlement letter from the company yesterday. The amount mentioned is correct; however, the letter includes clauses related to the payment that I do not agree with.
According to my research, and in line with UAE law, there is no legal requirement for employees to sign an internal release or waiver to receive these statutory entitlements.
