Can I take my company to court for not paying my basic salary after my visa cancellation?
Hello,
It's coming to one month after cancellation.
Can I report my company to court for not paying me my basic salary during my term of work?
Hello,
Employers are legally obligated to pay employees their agreed-upon wages on time. Failure to do so is a serious violation of the law.
Unless there are specific, legally justifiable reasons for withholding your salary (which are usually related to penalties outlined in the law or your contract and would need to be properly documented), your employer is in the wrong.
You may send them a reminder mail, and if they are not responding, you can file a complaint with Mohre.
If you need further clarification, you may ask.
Under UAE Labor Law (Federal Decree-Law No. 33 of 2021), specifically Articles 13, 27, and 53, an employer is legally obligated to pay an employee's wages on time and settle all dues, including unpaid basic salary, within 14 days of the termination or cancellation of the employment contract.
Failure to do so constitutes a violation, and the employee has the right to file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).
Thank You!
