When can I file an eviction case if my tenant refuses to vacate?

Dear Lawyers,

I am a landlord in Dubai and issued a 12-month eviction notice 9 months ago for the purpose of sale.

However, my tenant has replied that he cannot agree to vacate. When can I file the eviction case with the RDC?

Hello,

As a landlord in Dubai, you have the right to file an eviction case in the Rental Dispute Center (RDC) immediately after the 12-month notice period expires, as required by law.

It is essential to adhere to this notice period for your case to be accepted.

Please note that the court fee is 3.5% of the rental contract value, which is refundable upon winning the case. The tenant will be liable for this fee, in addition to any outstanding rent until full eviction.

Dear questioner,

According to Article 25 of Law No. 33 of 2008 on the Regulation of the Relationship between Landlords and Tenants in the Emirate of Dubai, a landlord can file an eviction case in the Rental Dispute Settlement Center (RDC) after the expiration of the notice period given to the tenant.

In your case, since you have given a 12-month eviction notice and 9 months have already passed, you can not file the eviction case in RDC now; you have to complete the 12 months.

If the rental agreement expires during this time, you have to renew it till the end of the 12-month notice.
