Dear Sir/Madam,

I recently purchased a tenanted apartment in Dubai. The current tenant's rental contract with the previous owner is set to end in March 2025.

I need your guidance on the legal process to notify the tenant of eviction so I can move in myself by the end of the existing contract.

Specifically, I would like to know:

- The legal process to notify the tenant of eviction.

- The costs associated with initiating the eviction notice.

- The required documents for issuing the eviction notice.

Dear Questioner,

You will not be able to move into the apartment until March 2025, as the eviction notice requires a 12-month notice period.

If you were to send the notice in June 2024, he would be required to vacate the apartment by June 2025.

The procedure involves going to the notary public and drafting an eviction notice for personal use. If the tenant does not speak Arabic; the notice must be in both Arabic and English.

The fees are approximately one thousand dirhams.

The required documents include the lease agreement, ownership deed, your ID card, and the tenant's ID card if available.

The eviction process for a tenant involves several steps:

First, review the tenancy contract to understand the terms and conditions, including the eviction notice period.

Next, serve a notice to the tenant indicating your intention to evict them at the end of their current lease, ensuring it is given at least 12 months in advance as required by law.

If the tenant does not comply, file a case with the Rent Dispute Settlement Committee, which handles landlord-tenant disputes in Dubai.

Both parties will then attend a hearing to present their arguments and evidence.

If the committee rules in your favor, a court order will be issued specifying the date by which the tenant must vacate.

If the tenant still refuses to leave, you can seek enforcement of the court order.
