Can the landlord send me an eviction notice for the reason of renovation?

My eviction notice and tenancy contract will come to an end on 5 May 2024. The reason for eviction is "renovation".

The landlord has not submitted any supporting documents to show that the property will be unlivable during the renovation or any approval from Dubai Municipality.

I went to the Trustee Center in Al Manara and they said that I can't open a case against the eviction until after the expiry, however, that doesn't seem right.

I need advice, please.

Thank you

Dear N.,

Thanks for your inquiry.

Regarding the above, we would like to inform you that, according to UAE law, a landlord can only evict a tenant for specific reasons, such as non-payment of rent, breach of tenancy agreement, or if the landlord needs the property for personal use.

In the case of renovation, the landlord must provide evidence that the property will be unlivable during the renovation period and must obtain approval from the relevant authorities.

In your situation, it seems that the landlord has not provided any evidence or approval for the renovation, which raises questions about the validity of the eviction notice.

You have the right to challenge the eviction notice and request more information from the landlord.

You can approach the Dubai Land Department's Rental Dispute Settlement Center to file a complaint against the eviction notice.

The center will review your case and make a decision based on the evidence provided by both parties. It is important to note that you can only file a complaint after the expiry of the tenancy contract.

In the meantime, you can also try to negotiate with your landlord and request for more information about the renovation and the approval from the authorities.

If the landlord is unable to provide this information, you may have a strong case to challenge the eviction notice.

Kindly feel free to contact us by phone or email.

Greetings

Thank you.

So if the landlord does pull the necessary documentation together for the renovation (if it is the real reason) before the end of the expiry contract, then he is compliant with the law?

There are certain things involved in this matter. You can easily defend yourself against the landlord when he files the case for eviction because of the absence of supporting documents.

And you don't have to evict from the house until you receive the supporting documents. You can easily reject this eviction when the landlord sends you an email during the time in which the eviction is going to take place.

And if he can not submit it, the eviction for this reason will not be accepted. We will discuss more. share your WhatsApp number.
