Can the landlord send me an eviction notice to make maintenance to the apartment?
Good morning,
I have just received an eviction notice. The reason for the eviction is the "urgent need for a notifier for conducting alterations and comprehensive maintenance".
I think that this eviction notice is unjustified as the apartment was completely refurbished in May/June 2022, with a new kitchen, bathroom furniture and fittings, new tiles, and a new water heater (I have a video of the ongoing works).
The works were still ongoing when I moved in, in June '22. I couldn't use the apartment to the full extent and unpack until the works were completed in September'22.
I suspect that the landlord wants to get rid of me due to the spike in rental prices in Dubai. According to the RERA calculator, she could raise the rent to a maximum of 15%.
In the case of letting the apartment to a new tenant, she would get much more.
Doesn't the landlord need to provide me with a technical report attested by Dubai Municipality together with the eviction notice?
What are my options? What can I do to prevent the eviction?
Greetings,
Yes, they must provide you with a maintenance report from the municipality to prove the serious desire for maintenance.
And you can stick to the lease until you find another property to live in.

Good afternoon
The notice is not valid because there is no report attested by Dubai Municipality.
If the situation gets more complicated, you can contact us to protect your rights.
The landlord has the option to give a 12-month eviction notice for comprehensive maintenance.
But if he is rerenting the property, you (the old tenant) should be given priority. If he is acting beyond the reason mentioned in the eviction notice, you can approach RERA for compensation.
Dear Questioner,
Thanks for your inquiry.
Regarding the above, we would like to inform you that, according to UAE law, a landlord can only evict a tenant for specific reasons, such as non-payment of rent, breach of tenancy agreement, or if the landlord needs the property for their own use.
In your case, it seems that the landlord is using the reason of "urgent need of a notifier for conducting alterations and comprehensive maintenance" as a way to evict you and potentially increase the rent for a new tenant.
However, the landlord must provide you with a technical report attested by Dubai Municipality to justify the eviction.
This report should clearly state the need for the property to undergo alterations and maintenance, and the reasons why it cannot be done while you are still living in the property.
If the landlord is unable to provide this report, you can challenge the eviction notice and refuse to vacate the property.
You can also file a complaint with the Rent Disputes Settlement Centre (RDSC) to resolve the issue. The RDSC will review the case and make a decision based on the evidence provided by both parties.
If the landlord is able to provide a valid technical report, you may still have the option to negotiate with them and come to a mutual agreement.
This could include a temporary relocation while the maintenance works are being carried out or a reduction in rent for the inconvenience caused.
It is important to note that if you do not vacate the property after the eviction notice, the landlord may file a case against you at the RDSC and you could face legal problems.
Please feel free to contact us by phone or email.
Regards,

Dear Questioner
As you mentioned above in the reason for property maintenance, there should be a technical report attested and approved from the Dubai Municipality together with the eviction notice.
You are not required to move from the apartment unless they provide a proper eviction notice. If you need our assistance in your matter, please share your Whatsapp number.
Dear Client,
Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.
In Dubai, if you've received an eviction notice for renovation or maintenance, your landlord should provide a technical report attested by Dubai Municipality explaining the work's scope.
If this report has not been provided, request it from your landlord.
Additionally, familiarize yourself with Dubai's rental regulations, especially regarding allowable rent increases.
Try to negotiate with your landlord to reach a resolution. If negotiations fail, consult with us and consider filing a complaint with the Real Estate Regulatory Agency (RERA) if you believe the eviction is unjustified.
For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

Yes, If you want, you can require this report from the landlord. The landlord is obliged to provide you the same as well apart from verbal notification.
In order to prevent this eviction, you can make this as a defense. At the time of filing this eviction case, the court will ask her to submit the report to the court. So you don't have to leave the apartment.
