He has the right to file a lawsuit at the Rental Dispute Resolution Center.

After paying for the 12-month eviction notice I understood this would be enough to legally evict the tenant, but it seems I will have to pay more legal fees to file the lawsuit.

Any idea of the cost? And can the legal costs be claimed back from the tenant?

The tenant just sits there and pays no fees?

The lawsuit fees are paid by the party who loses the case.

If you win the case, he will be obligated to pay the case fees. You can also demand rent until the tenant moves out completely.

Ok, it's good that he pays the fees.

Is that my lawyer fees or only the case fees of maybe AED 500?

Pays case fees only.

For the attorney's fees, this is an agreement between you and your attorney and he is not responsible for it.

If I file a lawsuit at the Rental Dispute Resolution Center, how long would you expect the case to last?

3 Dec 2023, 11:02

As I told you, it depends on the defendant's steps.

He may surrender at the first session, and the case ends immediately.

He may fight until the last moment, and the case may last longer.

The tenant has not paid the last 2 months' rent since the contract expired 2 months ago, and he only wants to enter another 12 months rental which I do not want.

Also, he has not returned the wall to its original state after he knocked it down.

Can I add the 2-month rent claim and wall cost to the eviction lawsuit or would I have to submit separate lawsuits for each?

All of this can be claimed in one case.

Dear Client,

Thanks for your question, I hope you are doing well. I will definitely assist you in this matter.

If a tenant in the UAE refuses to vacate despite a court notice issued 12 months ago, the landlord should follow up with the court to confirm the status of the case.

If a judgment for eviction has been granted, the landlord can proceed with execution through relevant authorities, including the police or court bailiff. Engaging the Dubai Rental Dispute Center (RDC) may also help.

For any further legal assistance, you can WhatsApp us. We have an extensive team of knowledgeable and experienced lawyers to provide the legal assistance you need.

We will definitely be happy to help you.

Thanks & Regards

ABDUL WAHIED
