Tenant eviction: After appeal rejection, can they still fight?
Hello,
I have filed a dispute in the RDC against a tenant for non-payment of rent. The judgment was in my favor and was approved.
The tenant filed an appeal, but it was rejected by the higher court.
My question is: now that I have filed for enforcement of the judgment, is there a possibility that the tenant or their lawyer will file another appeal, dispute the eviction, or ask for a stay?

Under UAE law, a tenant may file an appeal against a judgment in favor of a landlord if the tenant believes that the judgment was wrong or unjust.
However, if the higher court has already rejected the tenant's appeal, then the tenant can file for review of the appeal decision.
The tenant may, however, file a request for a stay of execution, which is a request to delay the enforcement of the judgment until the tenant has had a chance to appeal the decision.
The court may grant a stay of execution if the tenant can demonstrate that they have a valid legal argument for their appeal.
