Q: I bought an off-plan property. After completion, I found out that the property didn't correspond of what I have signed in the SPA. I withdrew from the contract. The legal consultant of the company claims that I'm not entitled to have back my 4% which I have paid to DLD. As I never became in possession of my property I am wondering if I can claim back my 4% which I have already paid due to the fact that the property under my name needs to be deregistered? س: هل يمكن أن تتم الصفقة / الصفقات التالية بين البائع والمشتري من خلال المتعهد ودائرة الأراضي والأملاك في دبي في يوم واحد؟ 1- دفع المبلغ  للمتعهد مقابل العقار. 2- يدفع المتعهد رسوم شهادة عدم الممانعة وتسجيل العقار في دائرة الأراضي والأملاك في دبي. 3- بيع العقار إلى مشترٍ جديد عن طريق البيع بالتوكيل في ذات اليوم. 4- يصدر المتعهد خطابًا إلى دائرة الأراضي والأملاك في دبي لتسجيل الملكية لصالح المشتري الجديد. 5- يسدد المشتري رسوم " عقود " و " الإمارات للحلول العقارية " وتسجيل الملكية في ذات التاريخ. 6- إصدار عقد البيع الابتدائي للمشتري الجديد من قبل دائرة الأراضي والأملاك في دبي في ذات التاريخ. 7- نقل ملكية نفس العقار عن طريق دائرة الأراضي والأملاك في دبي من الورثة الشرعيين للمتوفى إلى المشتري الجديد في ذات التاريخ. 8- خطاب تسجيل ملكية يوضح أن الورثة الشرعيين المتوفين قاموا ببيع العقار في ذات التاريخ. 9- انتهت صلاحية جواز السفر الخاص بالمحامي ( لذا كيف يمكن لهذه المعاملات أن تتم بصورة قانونية وفقًا لقوانين العقارات في دبي)؟

Q: I am an Emirati national and I have a unit in a building owned by a developer in Abu Dhabi; I have purchased it approximately three years ago. On 2 Oct 2018, I got an email from the developer that I need to pay 4% of the original purchase price to the municipality to get the unit registered under my name (title deed). This 4% needs to be paid by November. I purchased the apartment at approximately 1.3 million, however, the original price of the apartment was 2.2 million and they are charging the 4% based on that. I have also paid a 2% transfer fee when I purchased the apartment. What I'm saying is they expect me to come up with AED 86000 in one month or I would start getting fined. I don't think I have to pay anything. I've been to the municipality and their attitude was that someone must pay whether it is the developer or the unit owner, regardless of the circumstances.

Q: Dear Sir/Madam, In the transfer of property in Dubai, should the buyer pay the tax before or after the transfer? What if the buyer's agency intends to pay the tax after the transfer? They made my seller commit tax fraud because of this. Who is at fault?

This Resolution sets the fees for registration of real property dispositions in the real property register, including those related to completed, under-construction, or offplan real property, as well as the fees for services provided by Dubai Land Department.
