Q: Hello,
I made an EOI payment for one project with a developer in Dubai. In the agreement, it says if the seller is able to allocate the unit similar to the buyer’s requirements, in this case, it’s not refundable.
However, I am not happy with the unit and it doesn’t meet my requirements. For example, the view of the unit and the fact that it is on the last floor, the last floor doesn’t work for me although I requested a high floor.
And the unit has a city view although I requested a garden/park view in the EOI.
At this point, I canceled the purchase and asked for a refund to which I got a response that according to the terms and conditions of the EOI, it is not refundable which is not correct.
My requirements for the unit do not match the unit they allocated. What are my rights?

Who is responsible to pay the admin fee for tenancy contract renewal in UAE?

Q: Dear Sir/Madam,
I am in the process of renewing my tenancy contract and the agent is claiming AED 1000 administration fee for the renewal. This was not stipulated in the contractual agreement that was signed for the current rental term.
Am I responsible to pay this admin fee?
From my understanding, the landlord is responsible for paying the admin fee for renewal. Is this correct?
Please note that this is for the combined tenancy agreement only and not for the EJARI. I have the responsibility to renew the EJARI.

س: بدايةً، أنا جديد في دبي وكنت أبحث عن فيلا هنا. وقد وجدت فيلا كنت مهتمًا بشرائها. ثم قررت أن أشتريها، وقد قدم البائع الخاص بالمطور العديد من الوعود بخصوصها.
أعطاني البائع سعرًا جيدًا، وخطة سداد تناسب احتياجاتي، بما في ذلك تنسيق للمناظر الطبيعية والحدائق، ورسوم خدمة مجانًا لمدة عام واحد والتكاليف الأخرى المتعلقة بداخل الفيلا.
طلبت من البائع تأكيدًا خطيًا مذكورًا فيه جميع الوعود التي تم تقديمها. أخبرني أنني سأحصل عليه فقط بعد سداد دفعة الحجز بنسبة 20٪ من سعر الشراء. لسوء الحظ أنا صدقته ودفعت 20 % للمطور + 4 % لدائرة الأراضي واللأملاك بدبي.
بعد أن طلبت عدة مرات تأكيدًا كتابيًا، لم أحصل على أي شيء. لقد تراسلنا عبر تطبيق الواتساب وما زلت أحتفظ بالرسائل الصوتية وسجل الرسائل حيث تحدثنا عن كل شيء.
لديّ رسالة صوتية وعدني فيها عدة مرات بأن كل شيء سيتحقق وأنني سأحصل على تأكيد كتابي في وقت قريب جداً مثلما وعد به في المقام الأول.
اضطررت إلى العودة إلى بلدي لأسباب تتعلق بالعمل ولهذا السبب، فقد أردت أخذ نموذج الحجز معي لقراءته والتوقيع عليه في المنزل، لكن البائع لم يعطني الفرصة.
أصرّ البائع على توقيع النموذج في أقرب وقت ممكن، وجاء إلى بهو الفندق مع استمارة الحجز في الساعة 10 مساءً.
ألقيت نظرة بإرهاق على استمارة الحجز ولاحظت بعض الأخطاء مثل خطة سداد غير صحيحة، لم يتم ذكر تنسيق المناظر الطبيعية والحدائق ورسوم الخدمة المجانية لمدة سنة واحدة أيضا.
أخبرني أن هذا هو مجرد نموذج حجز مؤقت وهو يتعلق بالحجز فقط، حتى لا تذهب الفيلا لشخص آخر مهتم بها.
واختتم بالقول إن جميع التغييرات التي تم الوعد بها ستتم كتابتها في عقد الشراء.
ومع ذلك، فقد قمت بطباعة نسخة من استمارة الحجز من طابعة الفندق. لقد سألت البائع عدة مرات إذا كان هناك أي عقبة في العقد، فأقسم لي بأغلظ الأيمان أنه سيتم تحقيق رغباتي بشأن الفيلا وأن كل شيء سيكون على ما يرام.
في اليوم التالي عندما كنت في بلدي الأصلي ألقيت نظرة فاحصة على استمارة الحجز. لقد تأكدت من أن كل شيء كان خاطئًا في النموذج: السعر خطأ، وخطة الدفع خطأ، ولم يتم ذكر جميع التغييرات التي كنت أتمناها.
بالإضافة إلى ذلك ، فإن سعر الحجز لم يكن 20 ٪ كما قال لي. كان مكتوبًا في استمارة الحجز أنه كان علي دفع 10٪ من سعر الشراء. بالطبع، لقد اشتكيت على الفور.
بعد حوالي أسبوع واحد تلقيت مكالمة من البائع. أخبرني أنه لم يستطع تغيير السعر لأنه كان بالفعل أفضل سعر، وأنه لا يمكنه تضمين رسوم الخدمة المجانية لمدة عام واحد، ولا يمكنه تغيير خطة الدفع كما تم الترتيب لها من قبل.
أخبرني أنه يستطيع فقط إدراج بعض التغييرات القليلة المتعلقة بالفيلا ولكن ليس كل شيء تم الاتفاق عليه من قبل.
لقد شعرت بخيبة أمل حقاً وطلبت استرداد نقودي مرة أخرى. الإفادة الوحيدة التي حصلت عليها هو أنني لا أستطيع استرداد نقودي، لأنه لا يمكن استرداده من خلال استمارة الحجز.
أشعر بأنه تم تضليلي حقاً ولم أفكر أبداً في أن هذا يمكن أن يحدث لي هنا في مدينة مثل دبي، وخاصة من قبل مطور كبير بمشروع ضخم مثل هذا. أشعر باليأس لأنني دفعت مبلغًا ضخمًا.
ماذا أفعل؟ لدي دليل على جميع رسائل الصوتية وسجل رسائل الواتساب بيني وبين البائع.

Unpaid service charges in shared ownership: Who bears responsibility?

Q: Dear Sir/Madam,
I am a 50% owner of a leasehold property. The lease agreement does not specify joint or several liability. It only mentions "xxxx and yyyy" as the lessees.
We have not paid service charges for the last 3 years. The other co-owner left the house 3 years ago and ceased all communications with me. The co-owner is uncontactable.
The management company initiated an RDC execution case against me and my co-owner.
Am I liable only for 50% of the total due amount? Or am I liable for 100% of the due amount? Can you please inform the correct article of law that covers this issue?

Developer asks for full year's service charges despite purchase at year-end. Can I refuse?

Q: Hello,
I bought a property from a developer in Q4 2023 and got the keys handed over in November 2023.
They have returned to me to pay additional service charges for the entire year although I purchased the flat from the previous owner in the last quarter of the year.
I sent them multiple emails to explain the reason behind it and to ask them to send any legal statement showing that the new owners are responsible for paying additional fees, though this is unfair from my perspective as I have been the owner of the property starting from Nov 2023.
Some friends told me that they received a letter from their lawyers which they sent to the developer questioning this procedure and refusing to pay this.
Since I don't have such a statement to send to them as well, is there any opportunity for somebody to help me in writing one, hopefully getting the chance not to pay the additional fees?

Do I have to pay a penalty if terminated after completing my contract period? 0
Sir,
As per my contract period, they mentioned that if I leave the company before 1 year, I have to pay 5000 dirhams. But I have already completed more than 1 year and 3 months.
The company has given me a warning letter saying my work performance is low, and if I continue like this, they will terminate me. They didn't mention any charges, but they mentioned in the letter a top penalty procedure.
So I need to know whether I have to pay them any charges or not.

I'm 23, female, Pakistani, under my dad's sponsorship on a residence visa for the next 2 years.

I had a case at Al Barsha Police Station, Dubai, for one year.
On 22 April, the court announced a verdict and imposed a fine of AED 5000, which I paid on the very next day and got the certificate from DPP, which I took to the Al Barsha Police station and submitted there.
The police officer told me that they have removed the travel ban, and the records will be updated in other emirates within 24 hours.
It's been more than 48 hours now since I applied for a clearance certificate on the MOI app, and it has turned into status "review with the concerned party."
I don't have any other cases, only this case, for which I paid the penalty already.
Seeking expert advice, please.

We regret to inform you that we are currently unable to proceed with the visa cancellation for Mr. O*** F***** (Visa - Cancellation - ************) for the following reasons:
1. The company's trade license is suspended, necessitating coordination with the SPC team to address this issue.
2. The company has an existing violation, as B**** W**** M*** has exceeded their visa duration by 171 days. The company must either cancel the visa for the violator or renew it accordingly. Alternatively, late renewal or cancellation fines can be settled through an application on the portal.
3. The E-Channel has expired as of 01/06/2023, and it must be renewed before processing any visa cancellation.
4. The Establishment Card is approaching its expiry date

My employment visa was rejected without any reason stated. I contacted MOHRE, and they said it was rejected by ICP Abu Dhabi. I have never been to the UAE or any other country.
