س: أنا مواطن أمريكي (أب لطفل عمره تسع سنوات).
لقد طلقت مؤخرًا ولدي الحق القانوني منفردًا لحضانة طفلي. لا يُسمح لزوجتي إلا بزيارة واحدة مع طفلي (لمدة ساعتين كل أسبوع، تحت إشراف شخصٍ آخر).
زوجتي تعاني من مشاكل عقلية لم تُعالج. وهذا الأمر موثق في اتفاق الحضانة ووثيقة الطلاق.
إذا انتقلت إلى خارج دولة الإمارات العربية المتحدة، هل يحق لزوجتي رفع قضية مرة أخرى لإعادة النظر في الحضانة؟
هل المحاكم في دولة الإمارات العربية المتحدة ستأخذ في الاعتبار اتفاق الطلاق والحضانة الأمريكي الخاص بي؟

س: مرحبا،
أنا مواطن بريطاني أعيش في المملكة المتحدة، وزوجتي السابقة وهي بريطانية أيضًا، تعيش في أبو ظبي بالإمارات مع ابنتنا البالغة من العمر 8 أعوام وهي بريطانية أيضًا.
لقد تطلقنا من خلال المحكمة في المملكة المتحدة في العام الماضي في ديسمبر 2017. كما أصدرت المحكمة بالمملكة المتحدة قرارًا ماليًا بالانفصال التام في الشهر الماضي في غيابها لأنها لم تحضر أي جلسات في المحكمة هنا في المملكة المتحدة.
كان بيننا اتصالات غير رسمية للترتيب قبل الطلاق حيث كنت أسافر خارج المملكة المتحدة لرؤية ابنتي في دولة الإمارات. لكن أوقفتني عن رؤية ابنتي منذ شهر أكتوبر 2017.
قيل لي إن قانون المملكة المتحدة لا يمكن إنفاذه في دولة الإمارات، لذلك، ليس أمامي خيار سوى طلب رؤية الطفلة عبر المحاكم الإماراتية.
خلال هذه الفترة، بدأت في دفع نفقات المعيشة للطفلة عبر حسابي المصرفي في المملكة المتحدة إلى حسابها المصرفي في المملكة المتحدة، وهي غير راضية عن ذلك حيث طلبت المزيد.

س: إننا على وشك الطلاق ولدينا ثلاثة أطفال. من المرجح أن يتم منح الحضانة للزوجة والوصاية للأب.
هل يحق لها اصطحاب الأطفال والانتقال من منزلنا الحالي في إمارة دبي إلى إمارة بو ظبي لأنها تعمل هناك؟
تعيش عائلتنا في إمارة دبي منذ عام 2004، كما أن وظيفتي الحالية ومدرسة الأطفال موجودة أيضًا في دبي.

Is the appeal court's decision implemented automatically, or is an execution procedure required?
Q: Hello,
I kindly ask for clarification of the following situation:
The Dubai Family Court of First Instance gave the father visitation rights, and he has a Sharia Execution Case for implementation.
At the appeal, it was a tragic verdict: the judges rejected his visitation rights because the marriage was invalidated due to religious differences.
- Is this decision implemented automatically, or is there an execution procedure, with an execution writ, similar to the first instance?
- Is it possible for the father to still meet the child until the execution procedure is completed?
- Does Chapter 5 of the Federal Decree by Law on Promulgating the Civil Procedure Code, which deals with Executing Execution Writs and Decisions Related to Personal Status Matters, apply to the appeal or only to the first instance?

I bought an apartment, but the previous landlord is refusing to vacate it. The contract clearly states that the landlord should hand over the apartment on the day of the transfer.
Out of courtesy, I gave him three days to vacate so he could find a new place to stay, but the time has passed, and he is still refusing to vacate and hand it over.

My hair was damaged by a very known and professional salon. Can I seek refund and compensation?
Hello.
I went to a very well-known and professional salon (or so I thought) for a normal hair dye. The guy who did my hair left the dye on my hair for over an hour when it was supposed to be on for a maximum of 30 minutes.
He wasn’t paying attention to me walking around the store talking to everyone and also doing another customer's extensions.
Now my hair is potentially damaged, my skull burns, and is flaky (meaning the dye wasn’t ammonia-free which is extremely unprofessional for such an expensive salon).
I didn’t even get the outcome that I wanted and the dye color doesn’t even show. I talked to him about it but he shut it down so fast and gaslit me the whole time and made me feel like I was the wrong one and I was ‘complaining about something so light’.
Please let me know what I can do legally about this.

My company has filed a case against a client for failure to pay and bounced cheque. How to follow up?
Hello.
My company has filed a case against a client for failure to pay and a bounced cheque. The client's company is registered as a virtual office in the Creative City Free Zone in Fujairah, so our case is filed there.
The client basically purchased some equipment from us, and his payment via bank transfer did not go through and was rejected. Then, when we deposited his security cheque after multiple attempts to contact and no answer, the cheque bounced.
The company is under his wife's name, and we have filed a case on the same.
The court has accepted our application, however, they have instructed the execution bureau to get the Emirates ID of this authorised signatory. The bureau is asking us to get it, and we have no way to do so, unfortunately.
Without the Emirates ID, the court cannot freeze the bank accounts or put a travel ban, etc.
What are our options here?
