Can my husband take our 2-year-old daughter abroad without my consent?

Hello,

My husband has been threatening that he will take my 2-year-old daughter to Pakistan and leave her there with his family.

He has said this several times and has confirmed to my dad that he will be taking my daughter in the coming few weeks. We are both on his sponsorship.

What are my rights in the UAE? Can my husband travel with a minor without the mother's consent? How can I stop him from taking my daughter to Pakistan? Do I have any legal standing if I am under his sponsorship?

Thank you for your response!

The family circumstances have not been disclosed publicly, and I also don’t want to disclose any legal proceedings to him to not making matters worse.

Hence, I’m looking to understand, if he wants to travel without me to Pakistan with my child, will he be able to?

He is my sponsor and has access to all my documents and signatures, hence I’m concerned he might be able to fake a NOC to travel with her.

His mother and entire family reside in Pakistan, so he intends to leave my daughter there with them. What if we travel together, and he leaves her there and comes back? What are my options in that case?

He is legally not allowed to travel with the child outside the country without your consent.

You can obtain a quick court order to prevent travel. Your sponsorship of him does not legally affect custody or protection of the child.

Any threat he makes can be used legally to seek protection.

Under UAE Personal Status Law (Federal Decree-Law No. (41) of 2024 On the Issuance of the Personal Status Law), the mother is generally considered the primary custodian of a young child, especially if the child is below the age of 11 (for girls) or 13 (for boys), unless proven otherwise by a court of law.
