س: قمت بإرسال بريد إلكتروني إلى المستأجر بأنني أريد زيادة الإيجار الذي كان أعلى مما هو مذكور في مؤشر الإيجارات، قبل أكثر من 90 يومًا من انتهاء العقد.
رد عليّ المستأجر قائلاً إنه لا يريد تجديد عقد الإيجار. والآن عندما تبقى أقل من شهر على انتهاء العقد، وصلتني رسالة بالبريد الإلكتروني منهم مفادها أن العقد سيتم تجديده بنفس القيمة.
هل يمكن للمستأجرين تغيير رأيهم حتى بعد تقديم إشعار بعدم تجديد عقد الإيجار؟
بالإضافة إلى ذلك، حصلت على شهادة تقييم الإيجار والتي تبين أن الإيجار يزيد بنسبة 13٪ عن قيمة الإيجار الحالية.
فهل يمكنني زيادة الإيجار إلى المبلغ المذكور في الشهادة أم يمكنني زيادة 5٪ فقط؟

س: مرحبًا،
فيلتي مؤجرة منذ أغسطس 2018 بمبلغ 155000 سنويا، وتم الاتفاق على الدفع بشيكين، وتم تسجيل إيجاري في 2018.
في أغسطس 2020 (بتوقيت فيروس كورونا)، كنت خارج دولة الإمارات وطلب مني المستأجر خفض الإيجار إلى 142000 وعرض دفع دفعات الإيجار الشهرية عن طريق التحويل البنكي.
نظرًا لحالة فيروس كورونا، قبلت عرضه عبر البريد الإلكتروني ومنذ ذلك الحين، يدفع المستأجر الإيجار شهريًا من خلال التحويلات البنكية.
في أبريل 2022 (أي 90 يومًا على التجديد في أغسطس 2022)، أرسلت إليه بريدًا إلكترونيًا لمراجعة الإيجار مع زيادة القيمة الإيجارية للفيلا الخاصة بي.
ومع ذلك، لم يوافق المستأجر واستمر في القول إنه لا توجد زيادة في إيجار الفيلا الخاصة بي. تبادلنا العديد من رسائل البريد الإلكتروني. ولم نصل لنتيجة.
الآن في أكتوبر 2022، حصلت على شهادة تقييم الإيجار من دائرة الأراضي والأملاك في دبي والتي تنص على أن قيمة الإيجار الحالية هي 200000.

A tenant refuses to renew the tenancy contract with new conditions. What to do?

Q: Dear Sir/Madam,
I sent a renewal notice to my Dubai tenant with more than 3 months advance.
In the renewal, I adjusted the rental increase as per RERA of 5% and requested a change in payment conditions from 4 to 2 cheques.
The tenant agreed to the new amount but did not agree to the new payment conditions because, according to him, the provisions to change the terms in the contract allowed by RERA were only suggestions and not enforceable.
Therefore, the contract renewal has not yet gone forward because we do not agree with his interpretation.
While consulting our options, RERA updated the rental increase for the area from 5% to 15% since the tenant is paying well below market price.
We sent the tenant a new proposal with the updated RERA-allowed increase of 15%, offering back payments of 4 cheques.
The tenant refused again, arguing that the new proposal is not applicable since we are now out of the 90-day previous notification window required.
Please advise our options!

How to deal with a tenant who is not willing to pay market rent?

Q: Dear Sir/Madam,
Our unit is currently rented at a lower price. According to the market, it is 45% less, and according to the RERA Rental Index, it is 13% less.
The RERA Rental Index allows for a maximum increase of 5%, but the current market trend indicates that we should at least increase the rent by 15%, which is the minimum rent for similar units.
Can we increase the rent according to the market value, as the tenant is only willing to pay 5% more based on the RERA Rental Index?

The landlord wants to increase rent above RERA Index. How to renew my contract? 0
My landlord was asking for an unjustified rent increase of 9K, while the RERA calculator showed 3K. He was threatening to go through the Rent Valuation process, however, he only gave me a notice period of 83 days.
According to Dubai Decree No 43 of 2013 and Law No 33 of 2008, landlords are required to provide a 90-day notice period before making any changes to the rental contract, including increasing the rent amount.
Failure to comply with this notice period entitles the tenant to refuse the rent increase.
As the current contract is coming to an end by the end of next week, I have made several attempts to reach out to my landlord and his real estate agent to reiterate my interest in extending the contract and collecting the rental cheques at the old prices.
Also, I kindly requested that they provide me with the contract as soon as possible. Unfortunately, I have not received any response thus far, and considering that this week is a holiday week, I do not know what to do.

Is the RERA Index Calculator the sole source for determining rent increases? 0
Dear Sir/Madam,
I reside in a Dubai community, and my tenancy renewal is approximately 95 days away.
The landlord is proposing a 15% rent increase, primarily based on rents listed on propertyfinder.ae, claiming that my current rent is 25% below market rates.
However, the RERA Rental Index indicates "no increase in the rental value" as my rent is at the top of the quoted range, prompting me to reject the proposed increase.
The real estate broker he hired at the time of my move-in recently contacted me, serving as an intermediary, mentioning that he would conduct a DLD valuation, likely resulting in a higher value.
However, he is attempting to negotiate first, considering the cost of around 2500 AED.
If we were to dispute, is the RERA Index Calculator the sole authoritative source for determining rent increases?
Additionally, if the DLD valuation is accepted, what is the potential maximum increase?
