هل يستطيع المالك تأجير الفيلا مرة أخرى بعد إخراج المستأجر وعدم بيعها؟
س: أنا مالك عقار وقد أخطرت المستأجر (عبر كاتب العدل) بإخلاء الفيلا للاستخدام الشخصي أو البيع قبل 14 شهرًا. والآن أخلى المستأجر الفيلا قبل شهرين بعد إكمال عام واحد من فترة الإخطار. ثلاثة وكلاء عقارات يعملون على بيع الفيلا خلال الشهرين الماضيين ولكن السعر المعروض أقل مقارنة بسعر الشراء الخاص بي. يرجى إخباري إذا كان بإمكاني تأجير الفيلا مرة أخرى حيث إنني غير قادر على الحصول على مشترٍ للفيلا، كما يُعد إبقاء الفيلا شاغرة لأكثر من شهرين خسارة  لي. يتعين عليّ دفع أقساط قرض المنزل الشهرية ويصعُب الالتزام بذلك.

ماذا يحدث إذا لم يتم بيع العقار بعد إخلاء المستأجر؟
س: مرحبًا، أنا مالك عقار في دبي وأرغب في إرسال إشعار إخلاء قانوني لمدة 12 شهرًا إلى المستأجر لاعتزامي بيع عقاري بعد مدة إشعار الإخلاء. سؤالي هو: إذا لم أتمكن من بيع عقاري بعد عرضه للبيع في السوق وقررت تأجيره مرة أخرى، فهل يمكن للمستأجر اتخاذ أي إجراء قانوني ضدي أو المطالبة بأي تعويض؟ هل يحق له ذلك؟

Can the landlord evict me from the apartment to sell then rent it for a higher price?
Q: Hello, I am a tenant in Dubai. Last year in June, I signed my first rental contract in Dubai. One bedroom 864 sqft for AED 65,000. Later this year in October, I got an eviction notice saying that I need to leave the apartment when the contract ends because the owner has the intent of selling the apartment. A few days back in March, I got a call from his agent saying that no one is interested in the apartment because the landlord wants a big price so if I want, I can renew the contract. The new price for me will be AED 76,000. I took some time to think and then called him back saying that as per RERA they cannot increase more than 5% which will be 68,250 but I am willing to pay 70,000 not to move out. A few hours after the call I got an email that they re-inform me that I have to leave in June because they want to sell the apartment. Is it legal to kick me out like that because they want a bigger price? What actions can I take if they rent it out again after I move out?

Renting a villa after failing to sell it, even after offering it to the previous tenant?
Q: Dear Sir/Madam, I am a landlord and gave notice (through a Notary Public) to the tenant to vacate the villa for personal use or to sell it one year ago. The tenant vacated the villa after one year as per the notice. I failed to sell the villa after trying to sell it through multiple agents for the past two months. I re-offered my previous tenant the villa for rent for one more year as I failed to sell it, through email (7 days ago). However, I have not received any response to this email. Please advise whether I can proceed with renting the villa to another tenant as I am incurring losses by paying EMI, maintenance, etc. Please also advise if the previous tenant can still ask for compensation. Thank you in advance!

If the Public Prosecution appeals a not-guilty verdict with no new evidence, will it stay the same?
Hi Sir, My husband had a judgment where he was found not guilty, as the misdemeanor court stated that it doubts the charges against the accused and found no conclusive evidence except the statements in the report files. The court considered this invalid because there was no translator. After this, if the Public Prosecution appeals, will the verdict remain unchanged and be upheld if there is nothing more than this  Can you shed some light from your experience on this issue and say if the result will remain the same?

كيف يمكنني الاستعلام عن قضية إبعاد أمني ومحاولة العودة إلى الإمارات؟
السلام عليكم، أود الاستفسار بشأن قضية إبعاد زوج خالتي من دولة الإمارات العربية المتحدة. زوج خالتي كان مقيماً في الإمارات وكان قد وُلد وترعرع هناك. في عام 2013 تم إبعاده من الإمارات، وكان ذلك نتيجة لسياسات حكومية كانت تستهدف مجموعة من المقيمين في تلك الفترة، وهو لم يكن قد ارتكب أي مخالفة في ذلك الوقت وكان يُعتبر ضحية للسياسات المتبعة. أرغب في معرفة الإجراءات التي يجب أن أتبعها حالياً من أجل رفع هذا الإبعاد وتمكينه من العودة إلى الإمارات. أرجو أن توضح لي كيف يمكنني مساعدته في هذا الموضوع. شكراً جزيلاً.

Dear Sir/Madam, If an employee is still on probation period, can the employer terminate the contract with 14 days' notice even if the employment contract states 30 days' notice? The company is under MOHRE.

Is the RERA Index Calculator the sole source for determining rent increases?
Dear Sir/Madam, I reside in a Dubai community, and my tenancy renewal is approximately 95 days away. The landlord is proposing a 15% rent increase, primarily based on rents listed on propertyfinder.ae, claiming that my current rent is 25% below market rates. However, the RERA Rental Index indicates "no increase in the rental value" as my rent is at the top of the quoted range, prompting me to reject the proposed increase. The real estate broker he hired at the time of my move-in recently contacted me, serving as an intermediary, mentioning that he would conduct a DLD valuation, likely resulting in a higher value. However, he is attempting to negotiate first, considering the cost of around 2500 AED. If we were to dispute, is the RERA Index Calculator the sole authoritative source for determining rent increases? Additionally, if the DLD valuation is accepted, what is the potential maximum increase?

سيدي/سيدتي العزيز/ة، رُفضت تأشيرة عملي. عندما زرت مكتب الهجرة، طلبوا مني الحضور برفقة موظف العلاقات العامة الخاص بشركتي. فعلت، وأخبرني موظف العلاقات العامة الخاص بي أن تأشيرتي رُفضت لأسباب أمنية. لا أفهم سبب رفض تأشيرة العمل، فليس لديّ أي قضايا في الهند أو الإمارات العربية المتحدة. أنا جديد في الإمارات العربية المتحدة. هل يمكن لأحد مساعدتي في حل هذه المشكلة؟ ما العمل؟ هل هناك أي حل بديل؟

كيف يمكنني إغلاق شركة تابعة لراكز دون حضور شريكي؟
