أتمنى أن تكونوا بخير.
لديّ سؤال يتعلق بنزاع مع صاحب العمل وأنا الآن في انتظار تحديد موعد جلسة الاستماع في قضيتي. لقد قدمت استقالتي مع الاستعداد لإكمال فترة إشعار مدتها 30 يومًا بسبب ادعاءات كاذبة وجهها لي صاحب العمل.
لم يسير الأمر بشكل جيد معهم ورفضوا قبول استقالتي وأخذوا الكمبيوتر المحمول وبطاقة الدخول الخاصة بي وأرسلوا لي خطاب إنهاء بعد أربعة أيام. لقد تعرضت للفصل التعسفي مع رفض قبول استقالتي.
سؤالي هو؛ هل سأكون على صواب في حالة رفع قضية بسبب الفصل التعسفي والمطالبة بتعويض عن الأضرار وفقًا لقرار المحكمة بما في ذلك مكافأة نهاية الخدمة والإجازات المعلقة.
ليس لدى صاحب العمل أي نية للدفع ويهددني برفع قضية شرطة ضدي وإصدار توصية سيئة بحقي عند العمل في المستقبل.
يرجى تقديم المشورة لي فيما يتعلق بهذا الموقف بينما انتظر تحديد موعد جلسة الاستماع من محكمة دبي.

س: مرحبًا.
استقلت من شركة منذ 8 أشهر ولكن لم أحصل على تسويتي ومرتباتي المعلقة، وطُلب مني التوقيع على ورقة تسوية لإلغاء التأشيرة.
وحيث أنني كنت على وشك الانضمام إلى شركة أخرى، فقد وقعت على الورقة وأرسلت رسالة إلكترونية إلى قسم الموارد البشرية تقول أنني لم أحصل بعد على تسويتي عندما غادرت الشركة. لقد مرت 8 أشهر وقمت بتسجيل شكوى ضدهم.
إنهم يقولون إنهم سيفتحون قضية جنائية ضدي قائلين إنني سرقت موادًا وكنت معتادًا على الحصول على عمولة من الموردين والمقاولين من الباطن، وهذا ليس صحيحًا.
لدي مسألتين على الرغم من هذا لم أحصل على أي أموال من أي شخص ولم أسرق كما ادعوا علي.
1. كنت أخطط لبدء عمل تجاري مع أحد المقاولين من الباطن، وتخليت عن تلك الخطة. شركتي تعلم هذا.
2. قبلت فاتورة من أحد المقاولين من الباطن قبل أن يتم إصدار خطاب أمر شراء لهم وفقًا لتعليمات مدير المشروع.

تم رفض الاستقالة بشكل فوري. الوظيفة التي أقوم بها ليست هي التي في عقدي الموقع. المبلغ المدفوع موجود في عقدي ولكنه لا يتطابق مع واجبات وظيفتي. لقد تم منعي من القيام بما هو مدرج في عقدي وإلا فالاستقالة والعودة إلى بلدي.
لدي تسجيلات صوتية لمكالمات هاتفية يتم تهديدي فيها من قبل الرئيس التنفيذي.
كل هذا لأن جواز سفري في عهدتهم، لذلك وعدوني بأنني لن أعود إلى بلدي حتى أموت ولدي دليل على هذا التصريح.
بحاجة إلى نصيحة، من فضلك.

Do I have to serve my notice period after completing my rotational leave?

Q: Good afternoon.
I have been working with my employer for the past 3 years and 9 months. According to my contract, I am required to work 42 days and take 21 days of unpaid rotational leave.
6 months ago, my employer changed my rotational working cycle to 60 days of work and 60 days of unpaid leave. I did not agree to this change, but I have been working under this new cycle for the past 3 rotations.
I resigned from my job while I was on rotational leave and requested to be released from my contract with a 30-day notice period.
However, my employer informed me that I must first complete my rotational leave, which is 60 days, and then serve a 30-day notice period after returning to work.
I have another job that I need to start in 20 days, but my current employer is not releasing me. I officially submitted my resignation via email on July 12, 2023, from India.
Due to this issue, I traveled to Abu Dhabi on July 18, 2023.
Please advise me if I must serve my notice period after completing my 60-day rotational leave, or if it can be calculated from the date of my resignation.

Good day.
I would like to ask about this scenario.
This 1 staff sent a resignation due to delayed salary but the management agreed to reject his resignation and talk to him that the company still needs him.
This staff accepted the proposal then later on after 3 months, this staff did not go to work. It's like he will come twice a week and then he will not come again.
Now he sent an email to give him a termination letter. The management decided to accept his resignation ssubmitted 3 months ago but this employee wants a termination letter.
What is right? Is it okay if the management accepts his resignation?

Hi,
I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building.
The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024.
One of the articles in the MoU states:
In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates.
I need help urgently.

I was driving my car when the police stopped me at one point on the road and told me that I was driving under the influence of alcohol.
I tried hard to deny that because I had not actually consumed any alcoholic beverages that day or in the previous three days.
However, a report was filed and a case was opened, but the alcohol test report came back negative. Will I be convicted despite that?

We have an agreement with a company to supply food for their buffet on a daily basis, with invoices to be issued monthly and payment to be made every three months.
The relationship actually lasted for nine months, and payment was made for two periods. In the third period, due to disagreements between our company and the company to which the supply was made, they refused to pay, noting that the outstanding amount so far is fifty-four thousand dirhams.
Can we claim the amount, noting that the agreement is not written, but there are emails exchanged between us and invoices?

I visited a salon for a colouring treatment, during which two rounds of bleach, which is not what I booked in for, were given to me without proper approvals, and were applied back-to-back without a strand test or proper consultation.

What can I do if the landlord has not been responding to renew the commercial lease contract and Ejari? 0
Good day.
For the last 3 years, the landlord's office has not responded to renew the contract, so I contacted RERA for renewal.
The office doesn't respond to emails related to renewal, even though I started sending emails and reminders 2 to 3 months before expiry, and I have no choice but to contact RERA and send a notice.
Once the renewal was processed by law, the landlord's office delayed in releasing the Ejari. Since it is a commercial property, my renewals are related to a staff visa, and I have to pay delay penalties.
The landlord's office staff tried to take advantage of the Emirati owner, and no direct meeting was fruitful.
What is the law that safeguards expats and sorts out issues without mutual compromise as they try to force their terms to be acceptable by law and not supported by any documentation?
