لديّ مكتب في مركز دبي للسلع المتعددة. أريد إنهاء خدمة أحد الموظفين الذين عملوا معي خلال السنوات الثماني الماضية. إنه يعمل لدينا بموجب عقد عمل غير محدد المدة مع فترة إشعار مدتها 30 يومًا.
هل يمكنني إنهاء خدمته بعد قضاء فترة إشعار مدتها 30 يومًا؟
إذا تخلف الموظف عن العمل خلال فترة الإشعار البالغة 30 يومًا، ماذا سيحدث؟

لقد تلقيت خطاب إنهاء الخدمة من شركتي وطلبوا مني المغادرة دون قضاء فترة الإشعار.
قالت الشركة أنها ستدفع لي راتب فترة إشعار مدتها شهر واحد وراتب شهر إضافي. بموجب القانون، يجب أن أحصل على راتب فترة إشعار مدتها شهر واحد وراتب شهرين آخرين، أليس كذلك؟
فقط لعلمك، أنا أعمل لديهم بموجب عقد عمل غير محدد المدة. وفترة الإشعار المذكورة في العقد هي شهر واحد.

س: لقد تم إنهاء عقد العمل غير محدد المدة الخاص بي بعد العمل في الشركة لمدة 15 شهرًا دون قضاء فترة إشعار.
يقولون أن ذلك حدث لأن الإدارة العليا وجدت أن أدائي في العمل ليس جيدًا بما فيه الكفاية. لم استلم أي مستندات أو تحذيرات تُفيد بأنني أحتاج إلى تحسين أدائي في العمل وإلا سيتم إنهاء خدمتي.
لقد تم ترقيتي في شهر يناير من هذا العام بسبب أدائي النموذجي في العمل. ما هي حقوقي بموجب القانون الإماراتي والمادتين 120 و123؟
