س: السيد المحامي العزيز،
لدي عقد إيجار لمدة عام واحد في دبي، ينتهي في 25 نوفمبر 2018.
في الثامن من أكتوبر، أرسل لي المالك عقد تجديد إيجار، مع تعديل على بعض بنود العقد ويحتوي على بنود مختلفة عن ما كان موجودًا في العقد السابق.
قررت عدم تجديد العقد؛ لن أجدده بالشروط الجديدة ولا القديمة. في الأول من نوفمبر، قمت بإبلاغ المالك بأنني سأخلي الوحدة المؤجرة في تاريخ انتهاء العقد الحالي وهو 25 نوفمبر.
أجاب بأنني بحاجة إلى إخطاره قبل 90 يومًا من تاريخ انتهاء العقد، ولم أتمكن من ذلك، والآن يحق له الحصول على تعويض، ويطلب إيجار شهرين كتعويض.
ينص عقدنا على أن "المستأجر يوافق على إخطار المالك كتابةً بمدة 3 أشهر (90 يومًا) قبل انتهاء هذه الاتفاقية بنيته في تجديد أو عدم تجديد العقد".
ومع ذلك، لم تذكر أي عقوبات مالية لخرق بند الإخطار بعدم التجديد قبل الانتهاء من العقد بمدة 90 يومًا.
من فضلك أخبرني هل يمكنه أن يطلب منى ما يساوي شهرين من الإيجار؟

Is it required to notify the landlord in advance about non-renewal of tenancy?

Q: Please, can you advise.
Our landlord is demanding a months rent penalty for not notifying him 2 months in advance of our intention to vacate the premises.
However, our contract does not request us to give notification. It has one clause which states: "IF the tenant wants to leave the apartment BEFORE the expiration date of the contract, he/she shall give 2 months written notice and pay 1 months penalty."
We are leaving on the expiration date, so how can we be in breach of the contract?
There are no other clauses or statements in the contract which refer to leaving notice required, and the contract itself has a clause which deems it null and void after the 1-year expiry date.

ولكنه أخبرنا أنه يتعين علينا إخطاره قبل 90 يومًا، وبناءً على ذلك سيقوم تلقائيًا بتجديد عقد الإيجار لمدة عام واحد.

Q: Dear All,
Our landlord's manager has just sent us a message via Whatsapp that they will not be renewing our current contract which expires in 90 days.
I just wanted to know, does this not constitute an eviction notice which I believe needs to be sent a full year in advance, and to be sent too by registered mail?
Also, in this case, does a WhatsApp message carry weight as legal notice or do they have to send it by registered mail?
What other rights as a tenant do I have in this case?

What to do if the tenant refuses to vacate despite of two months eviction notice before contract expiry?

Q: Hello,
I'm a landlord looking to evict my tenant by the end of the contract. I've already sent him a 68-day lease non-renewal notice via email, which he acknowledged.
However, he's now claiming the notice is too short and he doesn't want to vacate (Abu Dhabi).
Do I have a case for court, and if it goes to the Rental Dispute Office, how long does the eviction process typically take and when can I file a case?
The tenant has been in the property for the past 5 years, but I failed to complete the Tawtheeq for 2022/2023 and 2023/2024.
I initiated the Tawtheeq request in 2022, but the tenant never completed acceptance from his side, so now it's pending in TAMM and blocking any new requests.
Any advice would be greatly appreciated.

Q: Hello,
My tenant's contract expired in August 2023. I understand that, by law, it automatically renews for a year if there was no communication between the tenant and landlord.
Based on this, the contract was renewed until August 2024. Now, my tenant has informed me that they plan to vacate the property in September with only 10 days' notice.
When I refused and stated that a 3-month notice is required, they claimed the contract is no longer valid and has expired.
I would like to know if the contract automatically renews each year, meaning if it expired in August 2024, did it get renewed again until August 2025?

Hello.
I went to a very well-known and professional salon (or so I thought) for a normal hair dye. The guy who did my hair left the dye on my hair for over an hour when it was supposed to be on for a maximum of 30 minutes.
He wasn’t paying attention to me walking around the store talking to everyone and also doing another customer's extensions.
Now my hair is potentially damaged, my skull burns, and is flaky (meaning the dye wasn’t ammonia-free which is extremely unprofessional for such an expensive salon).
I didn’t even get the outcome that I wanted and the dye color doesn’t even show. I talked to him about it but he shut it down so fast and gaslit me the whole time and made me feel like I was the wrong one and I was ‘complaining about something so light’.
Please let me know what I can do legally about this.

Does the existing tenancy contract between the tenant and the previous owner remain in force even after the new landlord has purchased the property in the middle of an ongoing lease?
And when should a new tenancy contract be made?

I was wrongfully terminated by my school under Article 44 on March 20th, 2023. I have a case in the labor courts, and the first hearing is on April 4th, 2023.
However, my employer is asking me to vacate the school accommodation. I asked the Ministry of Labor and the courts, and they informed me that the school cannot evict me until the case is resolved.

I'm extremely tense and need your kind feedback on the following issue.
If I have a travel ban in KSA, can I travel to the UAE on a work visa?
I have been visiting Dubai on a tourist visa without any problems.
The ban was imposed because I had to leave KSA suddenly and could not return after an exit-entry, and I was unable to pay back my car EMI and credit card payment totaling 30k SAR, which I intend to pay off gradually now.
When I left KSA, they only had my fingerprints at the time. I also understand that while coming for a visit to Dubai, only a retinal scan is done.
On the other hand, when obtaining a work visa, UAE takes and registers fingerprints as well. Could this lead to any issues for me?
I have finally obtained a better-paying job after a long time and can finally save up to pay off my debts. The case registered for which the travel ban is imposed is only for SAR 16000.
As of now, I cannot afford to hire a lawyer to check in UAE.
