Mandatory restriction on probation time and extension
I am working with a renewed company.
In my offer letter, it's clearly written I will be placed under 6 months probation period, and after that, my salary will increase.
But now 10 months are about to end and they didn't increase my salary. I got an email that they extended my probation period for 3 months.
I performed very well as compared to other staff.
Kindly guide me, what should I do?
Thanks.
I assume you work for a local LLC company or a free zone company (excluding DIFC and ADGM).
Article 37 of the UAE employment law states that the probation period cannot exceed 6 months.
Article 37 -
The worker may be employed for a probation period not exceeding six months where the employer may terminate the services of the worker without notification or end of service gratuity. The worker may not be employed by the same employer for more than one probation period.
Should the worker successfully completes the probation period and pursues in his job, the said period shall be deemed as a part of the service period.
After the six month probation period, the employment automatically becomes full employment (not probation anymore). I hope this information serves the purpose.
I advise you to make your HR aware of the applicable laws - referencing the above article of the UAE employment law.
