Claiming accumulated annual leave days upon termination

My employment was terminated with a proper 30-day notice by the company. I have worked 3 years 7 months and 10 days.

I took 8 days per year annual leave instead of 30. Now that I am leaving, I wish to be reimbursed the unused leave.

How many days unused leave can I claim according to the law?

In accordance with Article 78 of the Federal Law 8 of 1980 as amended, you can claim wage and leave salary i.e. Basic Salary plus Housing Allowance if you have worked during your annual leave, and the period of leave during which you worked has not been carried forward to the next year.

If the same has been carried over, for the 3 years, you will be entitled to unused leave salary for 66 days (22x3).

For the 7 months and 10 days, you are entitled to an annual leave of 8 days on pro-rata basis. Unused leave salary will depend on if and how many days you have utilized of the total 8 days.

Whether your annual leave has been carried over or not will depend on the company’s treatment of annual leave and should be reflected in your personal employment contract, in particular, those companies that have a strict policy of not carrying forward the leave.
