س: السلام عليكم، في حالة عدم وجود الشخص داخل الدولة، كيف تتم عملية التنازل؟ وما الشروط الواجب توفرها في وثيقة التنازُل التي سيوقَّعها الطرف خارج الدولة؟ هل يجب أن تكون مُمضاة في سفارة الإمارات؟

How to avoid a UAE ban in case of old TB scars?

Q: Assalam Alaikum Mr Mohamed. My name is G., and I am residing in Dubai married and living with my husband. I did my medical for employment visa and unfortunately, my medical report is unfit due to an old TB scar. Now if I leave the county, the Dubai government will impose a ban on me. Since I want to live with my husband and he is ready to sponsor a visa for me, is there any legal way that I can stay in Dubai with the government permission and not getting ban for 1 year or a lifetime? Kindly help me to resolve this issue as we both are new to the country and no one is guiding us properly. We are very helpless. Please, it`s a request. I will wait for your reply.

س: السلام عليكم، أنا محاسب أعمل بالسعودية متزوج وحدث خلاف بينى وبين نسيبي، وانضمت زوجنى لأخيها ورفعت قضية بالمنقولات، وأخذت حكم لصالحها من محكمة الأسرة بما فيها الذهب، رغم أن المنقولات والشقة والذهب فى حيازتها. لازلت فى السعودية وعملت استئناف والمحامى أهمل فى القضية وتم تأييد الحكم ورفعت قضيه نفقة وحكم لها وأيضًا تم تأييد الحكم فى الاستئناف بمبلغ كبير على أساس أنى أعمل بالخارج. طلبتها عن طريق إنذار بالطاعة وعارضت بعد المدة واترفض ورفعت قضية طلاق للهجر رغم أننى متزوج وأنا كنت أعمل فى السعودية وهى تعلم ذلك، ولكن حكم لها فى أول درجة بالطلاق. لقد استأنفت ولم يحكم في الاستئناف إلى الآن. حان الآن موعد نزولي في أجازة إلى مصر، رغم أنه لا يوجد حكم بالحبس ضدى حتى اليوم، لكن أخشى كيد زوجتى إذا نزلت أن تعمل لى منع من السفر أو أوضع على قوائم الترقب فى المطار ويضيع عملى بالسعودية ولا أستطيع العودة مرة أخرى لعملي وأخسر مستحقاتي. هل من مخرج قانونى يضمن لى حرية السفر؟

The employer already showed me an entry permit of my nephew. But, the agency is still calling me that they will file an absconding case. Can they do that? Possibility of travel ban in the GCC for an unpaid loan in the UAE

Q: Good day. My husband has a loan with a UAE bank. He has left the UAE a few years ago and has not paid the monthly payments. Therefore the bank already approved to file a police case against him. He wants to visit one of the GCC countries for business and he wants to work there. Thus he has contacted the bank to ask for rescheduling a new monthly payment plan and clear the police case. However, the bank wants to have the total amount of his loan. I`ve heard that if someone has a financial police case in the UAE and when travelling to GCC countries, he will be arrested in any of the GCC countries airports, is it true? I am specifically asking about those businessmen who have business loans from banks and unable to service the loan, where the banks file a criminal case against the owner known as bounced cheque case. Are these businessmen also covered under the insolvency law, so that they get a chance to sort out their debts?

س: حصلت على قرض استهلاكي ويُفترض أن أنهي سداده بعد 60 شهرًا. دفعت منهم 20 شهرًا، وبعد ذلك لم أتمكن من الدفع لأنني فُصلت من الشركة فصلاً تعسفيًا. هل يوفر القضاء المصري إجراءً يُمكِّن من تعجيل الفصل في الدعوى التي أقمتها ضد الشركة التي فصلتني؟ أو بالأحرى لا أدفع أي مستحقات للقرض إلى أن تُنظر الدعوى اللي أقمتها ضد الشركة التي عملت فيها؟

س: عملت مع شركة للتسويق الرقمي. وتمثل عملي في إقناع الأشخاص بدفع أموال للشركة وأحصل أنا على مكافأة. حدث ذلك وأقنعت بعض الأشخاص بالعمل معنا وقاموا هم بدورهم بإقناع أشخاص آخرين. الشركة متعثرة حاليًا، وليس لديها أموال تدفعها لهؤلاء الأشخاص. سُجنت مالكة الشركة عدة مرات بتهمة النصب والاحتيال. هددني أحد الأشخاص الذين أقنعتهم برفع قضية ضدي إذا لم أدفع له ماله رغم عدم وجود عقد بيننا؛ فأنا لم أفعل شيء سوى أنني جعلته يسجل في هذه الشركة من خلالي، وكان يتم أي تعامل بعد ذلك بينه وبين الشركة مباشرة. هل يمكنه اتخاذ إجراء قانوني ضدي؟

Bounced cheque case by the landlord after paying the rent

Q: I had given a cheque to my previous landlord which got bounced. Later, I had paid the amount by cash in his bank account and have handed him over the bank receipt as well. I do have a copy of the bank receipt signed by his manager also. Although the money is paid, he didn`t return me the cheque and rather lodged a police case of cheque bounce. Also, he has given me a clearance certificate against the flat. What can I do when I am not in fault? Kind advice will be highly appreciated.
