Coming back to the UAE after accepting a plea for mercy

Q: I got charged with possession of drugs, 2 years ago, and executed my judgment 10 months ago (deportation). I applied to the Ruler’s Court for amnesty, to get acquitted of the crime, and have my record cleared. In February 2020, my wishes came true. The Ruler`s Court has accepted my plea for mercy and has cleared the deportation and record. I would like to know how do I proceed to come back to the UAE and whether any issues will arise if I do go back. Would I get detained again?

Q: Hi, I have lived in my current apartment for 14 years. This year in Jan 2020, I called the office to ask for my new rent details from 1st Jan 2020 to 31 Dec. They told me that I was having a court case as I didn`t pay last year`s rent. I handed over 4 cheques in 2019, but I didn`t wait for a receipt and never went to collect my tenancy agreement as I haven`t done for almost 2 years. They always handle things and I trust them. It turns out no rent cheques were cashed for 2019, no one in the office can find the cheques, no tenancy was signed and no one contacted me in a year. I assumed that the cheques were going to be deducted from my account. What can I do? Thanks!

Identifying the grace period after holding visa cancellation

Q: Dear Madam, My visa has already expired on 10th Feb and I asked my employer to hold my visa cancellation till 29th Feb. They agreed. So I want to know what will be my grace period to stay in the UAE? Is it till the 10th of March or will I get a grace period of 30 days after visa cancellation from the employer, which is 28th March? الزواج دون علم أو موافقة ولي الفتاة بسبب رفضه

س: مساء الخير، أود الاستفسار عن حالة حصلت معي وأبحث عن حل. كنت مقبلاً على إجراء عقد زواج بيني وبين فتاة تحل لي شرعًا برضا أهلي وأهلها، وقبل موعد الإجراء بفترة قصيرة، قرر والدها تأجيل العقد تعسفًا حتى موعد آخر يتعلق بتخرُّجها من الجامعة بعد ثلاث سنوات. كان قد سبق له أن أجَّل زواج ابنته الأكبر لثلاث سنوات بنفس الطريقة وهدد ابنته بالقتل إن تجاوزته وأجرت الزفاف. أنا والفتاة نرغب في إجراء عقد زواج خارج المحكمة يُمكِّننا من الخلوة الشرعية لفترة ريثما يأذن والدها بذلك؛ حيث إن العقد في المحكمة يؤدي بالضرورة إلى إعلام الأب وهذا ما لا تُحمد عقباه. نحن نريد أن نبقى في إطار الحلال ولا نريد أن نخسر والدينا ومجتمعنا ولا نرى سبيلاً لذلك سوى الزواج خارج المحكمة. أنا والفتاة ندرس في محافظة بعيدًا عن أهلنا وهو ما سيُسهِّل علينا هذا الحل. وسؤالنا هنا: ما الإجراءات اللازمة لإتمام هذا العقد؟ وهل يجوز أن نستأجر بيتًا بشكل قانوني نعيش فيه معًا ريثما يأذن الأبوان بتثبيت الزواج بناءً على هذا العقد؟ ساعدونا جزاكم الله خيرًا!

س: السلام عليكم، كسبت قضية إيجار ونفذت وعممت عليه ولكن المدعى عليه، بعد سنتين من التعميم، استأنف الحكم وقُبل الاستئناف وعادت القضية إلى القاضي، ولكني أخذت الحكم مرة تانية. وسؤالي: هل الفائدة القانونية على المبلغ يتم حسابها منذ بداية القضية الأولى قبل 3 سنوات؟ وهل يحق للمدعى عليه أن يستأنف بعد التعميم عليه لمدة سنتين؟ شكرًا لحضراتكم!

حبس المدين عندما يمتنع عن سداد باقي الأقساط

س: السلام عليكم ورحمة الله وبركاته، تم رفع قضية على مُستأجر امتنع عن دفع الإيجار وبعد الحكم لصالح صاحب السكن، تم عمل تسوية ودفع المحكوم عليه ربع قانوني وبعدها امتنع عن دفع الأقساط المستحقة عليه. طلبت من المحامي أن يرفع طلب حبس على المحكوم عليه، لكنه رفع طلب حجز على سيارة باسم المحكوم عليه؛ بحجة أنه يسقط حقي بطلب حبس المدين في حال دفع الربع القانوني، فهل هذا الكلام صحيح؟ وفي حال الحجز على السيارة، هل سيتم أخذ السيارة من الشخص في حال القبض عليه أم سيمنعه الحجز من بيعها أو رهنها فقط؟ أعتذر عن الإطالة وشكرًا جزيلاً!
