هل يُسجَّل حكم الجنحة بشهر حبس في الصحيفة الجنائية؟

س: هل حكم الجنحة بشهر حبس يُسجَّل في الصحيفة الجنائية ويظهر في الفيش وتعتبر سابقة؟ علمًا بأنه تم قضاء المدة منذ خمس سنوات؟ وإذا كان يُسجَّل، فكيف أحذفه؟ شكرا على وقتكم!

Can you resign without a notice period for the non-payment of salary?

Q: Dear Sir, I am working as a pharmacist in a single pharmacy in Ajman since July 2015. I am the only employee in this pharmacy. My contract is unlimited and my salary is 5500 (basic 2000). My 18 months` salary is pending since 2019. I filed a labor complaint in November 2020 and my employer promised me to pay an additional salary from January 2021, so I withdrew my complaint. After the labor complaint, my salary was a bit regular but there were some months when the salary was pending. I had the trust that he will clear my pending salary. My visa is till May 2022. I request you to guide me in this situation since I do not want to continue the job. Also, can I resign without notice period? Regards

What can be done in a case of assault and rejection of bail?

Q: My husband is being held in custody on charges of indecent assault. The case has been under investigation for over 10 days now, the prosecutor has spoken to him once. They have rejected bail applications as well. How long can he continue? If the complainant clears the case (gives tanazul), can the prosecutor still punish him? (through penalty or anything else). Also, I am not able to know the reason for the bail rejection. Are they obliged to give a reason?

المطالبة بسداد كمبيالة بعد مضي 16 سنة

س: شخص يطالب بسداد كمبيالة بكامل المبلغ وقد مضى عليها ١٦ سنة تقريبًا. هل له الحق في ذلك؟ علمًا بأن لدى المُدّعَى عليه سندات بنصف المبلغ تقريبًا وباقي السندات مفقودة.

إبلاغ الشركة الموظف بعدم تجديد العقد ثم التراجع عن ذلك

س: أنا موظف بعقد محدد المدة ينتهي بانتهاء مدة العقد أو بانتهاء المشروع، أيهما يسبق الآخر. حُددت في العقد فترة إشعار ٦٠ يومًا إذا لم ترغب الشركة في التجديد، و٩٠ يومًا في حال لم يرغب الموظف في التجديد. أرسل لي من قبل الشركة إشعارًا بعدم التجديد لانتهاء المشروع قبل نهاية العقد بـ ٦٠ يوم. وقعت عليه وأرسلته لهم كما طلبوا. في آخر يوم عمل في العقد، أُبلغت بإصدار إشعار تجديد العقد. أرسلت خطاب عدم رغبتي بالتجديد. هل أتحمل أي أضرار لرفضي التجديد؟ وهل تُصرَف مستحقاتي ومكافأة نهاية الخدمة؟ للعلم لم أخبر الشركة بعدم رغبتي في التجديد لأنهم أعطوني إشعارًا بعدم تجديدهم لعقدي.

فسخ عقد إنشاء فيلا مع مقاول بناء للتأخر ببدء البناء

س: مرحبا لدي عقد مع مقاول لإنشاء فيلا مع المواد عظم بمدينه الخبر. مده العقد 7 أشهر وغرامة في حال التأخير. كان هنالك دفعه أولى 20% من قيمة العقد. مضى أسبوعان ونسبة الإنجاز لا تتجاوز 1% مع العلم أنه لا تأتي العمالة للموقع حيث مضى أسبوعين من العقد وعدد الأيام التي حضر فيها العمالة 3 أيام فقط. هنالك شرط بالعقد أنه يحق لي فسخ العقد في حال كان هنالك بطء في إنجاز المشروع. كيف يمكنني إجباره على فسخ العقد واسترداد الدفعه المقدمه بأسرع وقت؟

س: السلام عليكم ورحمة الله وبركاته أخ شهاب، يا رب تكون بخير! سؤالي بعد إذن حضرتك صدر لي عقد إلكتروني ورفضته وقد اشترك كفيلي لي في التأمينات الاجتماعية براتب غير الراتب المذكور في العقد بيني وبينه والذي قدمت وفقه من مصر. ماذا أفعل؟
