هل يمكن التنازل عن حق على عقار خارج دائرة الأراضي؟

س: أمس ذهبت أنا وأخي إلى محامي لأجل موضوع أرض بجانب بيتي لكي يستعملها أخي ويوقف سيارته فيها. علمنا أن الأرض التي تحيط بالمنزل خليط وشريك بيني وبينه. قام المحامي بعمل تنازل خطي لذاك النصف الذي هو بجانب بيتي وأخذ فلوس بقيمة التنازل ٤٠ دينار. هل هذآ التنازل يجبرني أن يأخذه أخي كونه خارج دائرة الأراضي؟ وشكراً

تهديد العامل وإجباره على إنهاء الخدمة

س: السلام عليكم، أعمل في فندق حكومي. لم أستلم رواتب أول ستة أشهر من العمل. تعرضت لضغوطات كثيرة من طرف المدير؛ مثل: العمل لساعات إضافية مجانًا، وتغيير موقع العمل كل يومين، وإعطائي عقوبة الجلوس في البيت بدون أي مبرر لمدة شهر مع العلم أنني الوحيد الذي يتعاملون معه بهذه الطريقة. عندما تكلمت عن حقي مع المدير، أحضروا ورقة إنهاء الخدمة ويجبرونني على توقيعها يوميًا ويحاولون منعي من دخول الفندق، وكذلك إخافتي وتهديدي بإحضار دورية الشرطة في المرة الأولى ورجل مباحث الفنادق التابع لشرطة أبوظبي في المرة الثانية والذين هم أصدقاء المدير. مع العلم أنه عند محاولتي فتح تطبيقات مثل تطبيق ICA أو MOHRE أو UAE Smart ID، أتفاجأ أن رقم هاتف الفندق أو مندوب الفندق هو المُسجّل في قاعدة البيانات الخاصة بي في الجوازات. أطلب مساعدتكم لإرشادي. ماذا أفعل لأنني مقهور أقسم بالله؟

هل يُعد الرد على ادعاءات وتصريحات تشهيرية جرمًا؟

س: السلام عليكم، عند قيام شخص في دبي بالظهور عبر الإعلام بالصوت والصورة والإدلاء بادعاءات وتصريحات "تشهيرية" كاذبة بحقي بخصوص عمل جمعنا سابقًا مع ذكر اسمي الكامل صراحةً، في هذه الحالة إذا أردت أنا الظهور عبر الإعلام للرد على تصريحاته الكاذبة جبرًا لحقوقي الأدبية والمعنوية، هل يعتبر هذا تشهيرًا أم أنه "حق رد" مكفول؟

المطالبة بعمولة غير مذكورة في العقد ولكن مُتفق عليها

س: السلام عليكم، لدي مشكلة مع شركتي وأحتاج استشارة لرفع قضية عمالية. هل يمكن المطالبة بعمولة تم الاتفاق عليها ولم تُذكَر في عقد العمل ولم تُدفَع بشكل دوري أو في موعد محدد ومدة العمل كانت ٨ سنوات؟ العمولة كانت تُدفَع بشكل متقطع وبدفعات تحت الحساب، فهل يحق المطالبة؟ الشركة ترفض دفع العمولة بحجة أوضاع الكورونا. مع العلم أني كنت أستلم الدفعات بشيكات. بارك الله فيكم أفيدوني!

The anticipated compensation for a patient for medical malpractice

Q: Hi, A patient has filed a civil case against me after he developed a clot which the radiologist misdiagnosed and said that it was not there. It is a well-known complication of any orthopedic surgery but treated by a vascular surgeon. I followed all protocols and DHA said since the patient was originally mine, I should have paid more attention but no action was recommended against me. Based on this, the patient filed a civil case against the hospital as the report also said the hospital is responsible for hiring an incompetent radiologist. I no longer work for this hospital and they asked the court to include me in the case too. What are the usual compensations awarded by the court if there is no loss of life or any body function? And will medical malpractice cover it, if so which one; my current one or the one that still insures the hospital? Thanks!

رفع دعوى شيك بعد مضي ستة أشهر وتخلف المدين عن السداد

س: السلام عليكم، سلَّفت شخصًا مبلغًا بضمان شيك صادر من شركته الخاصة وموجه لاسمي. بعد تخلُّفه عن أداء الدين، ما استطعت اتخاذ أي إجراء لأنني أضعت الشيك في محيط المكتب ولم يكن لدي صورة أو رقم مرجعي وطبعًا المدين رفض التعاون وأنكر السلفة. مؤخرًا وجدت الشيك ولكن مضى 6 أشهر. ما الحل الأنسب في هذه الحالة؟ وهل الأفضل توجيه الادعاء ضد الشخص نفسه أم ضد شركته الخاصة؟ وهل أستطيع أن أطالب بالتعويض؟ علمًا بأنه تسبب لي بضرر مادي لعدم إرجاع الدين. شكرًا على حسن التعاون!

What to do in case of ignorance of the termination notice of the tenancy contract?

Q: Dear sir/madam, I was not aware of the 90 days prior information to be provided to the landlord and neither the agency told me about it while signing the contract. It is nowhere mentioned on the contract that I should notify 90 days prior to the end of the contract term. I did inform them 26 days before vacating and then the agency told me that I should have informed them 90 days prior and now there will be a penalty. I feel cheated through the lack of information provided. What to do in this case?

Can a transfer of the deceased company shares be revoked for being technically defective?

Q: A transmission to ultimate beneficiaries seems to be technically defective from the wording of the deceased`s Will. The Shares of the Deceased should have been transmitted to 3 Trustees including the living spouse of the deceased but instead, they were transmitted to the ultimate beneficiaries named in the Will (including 2 of the Trustees but excluding the living spouse of the Deceased), which transmission would take place only upon the death of the living spouse. My question here is, can the defective Transmission be revoked and rescinded by the Board of Directors & the entries in the Register Of Members kept at Companies Commission be reversed back accordingly? Instead of going through a formal Transfer of Shares to reverse the transaction. Thereafter, a proper and correct transmission is to be done, transmitting the Deceased`s shares to the 3 Trustees as stated in the Deceased`s Will. Would appreciate advice on this matter. Thank you

Q: So there is this new law applicable on Jan 2, 2022, where convicts of bounced cheques will all be cleared and found innocent. Question 1: Will this apply to civil cases that have passed all stages and are under execution?
