س: مرحبًا، لدي استفسار. أبرمت عقد عمل مونتاج لمسلسل تلفزيوني. حدث تأخُّر كبير في تسليم الحلقات وأخطاء ومشاكل كبيرة بالحلقات المسلّمة. وفي هذه الحالة، وجب تطبيق الشرط الجزائي المتَّفق عليه بالعقد بقيمة 1000 دولار مثلاً. إذا كان متبقي للشخص المتعاقَد معه بحسب العقد دفعة أخيرة لما بعد التسليم بقيمة 500 دولار، فهل تُخصَم في هذه الحالة من قيمة الشرط الجزائي أم يسقط حقه في الدفعة الأخيرة ويُطالَب بدفع الشرط الجزائي بالكامل؟ Questions & Answers

Cancellation of a purchased property SPA and refund for handover delay
Q: I purchased an off-plan apartment from a developer with payments plan 20/80. I have paid 20% so far plus 4% DLD. The developer has not given me my land registration yet. According to my SPA, the property handover is supposed to be in Q1 2020. I received a notice that the new completion date is now Q1 2021 but is doubtful. Claiming penalty for delay in property handover or termination and refund
Q: I have purchased a property in a Dubai project and as per my agreement, they are supposed to give me possession by the second quarter of 2019. However, they have still not given possession and when I ask for the delay compensation of 4%, they are not responding to that. As per Dubai Real Estate Law, can I cancel the contract? I am no more interested in continuing with these guys. If I file a case in the court, will the court ask them to pay the delayed charges as well as the legal expenses? Changing the punishment of a bounced cheque case from jail to fine
Q: I have a bounced cheque case which was filed in Bur Dubai Police Station in December 2016 for AED 80,000/-, and in 2017, the judgment was issued in absentia (One-month jail term). Please note that I have already paid AED 35,500 to the claimant in instalments even before the judgment was passed. Also, this judgment was issued prior to the implementation of the fine system for cheque value AED 200,000 and below.
