Removing a criminal police case to return to the UAE

Q: Dear sir/madam, I owe a bank for a personal loan in Abu Dhabi. I have since left Abu Dhabi. I have contacted the bank and they will not negotiate, however, I find myself needing to return to the UAE. Q: Dear sir/madam, Last year, I approached a company to open a UAE sole establishment for me. Instead, they opened a civil company without my knowledge and then asked me to sign MOA (Partnership Agreement) using my UAE pass without even showing the MOA (Partnership Agreement) to me. س: السلام عليكم، أعطيت شيكًا لشخص مقابل دين 35000 درهم وأعطيته بعد مدة مبلغ 5000 درهم وقبِل تقسيط باقي المبلغ. بعد 15 يومًا من دفع 5000 درهم أدفع باقي المبلغ كاملاً أو يشتكي. ما الوضع القانوني في هذه الحالة؟

What can the seller do if the buyer cannot continue with the purchase of property?

Q: We signed DLD Form A, and agreed to buy a villa worth AED 11.7M, and gave a security cheque of AED 1M. But now due to some funds issues, we are not able to buy that villa. We are requesting the seller to terminate the contract and also we will bring any other buyer for you. Now, the seller doesn`t want to cancel the contract and threatens that he will deposit the security cheque. Can anyone guide how to come out of this issue? Will you assist us with this, please?

إثبات الحضانة للأب إن لم تطلب الأم إثباتها لها في الدعوى

س: السلام عليكم، قضت المحكمة بالطلاق لانقضاء العدة في دعوى طلاق. المدعية في طلباتها الختامية لم تطلب إثبات الحضانة لها والمُدَّعَى عليه في طلباته الختامية طلب توجيه اليمين الحاسمة أنها تنازلت عن الحضانة بعد الطلاق. المحكمة رفضت توجيه اليمين على أساس أن المدعية لم تطلب الحضانة في طلباتها الختامية ولم تنازع المُدَّعَى عليه بالحضانة واكتفت بذلك بالتسبيب ولم تُثبت الحضانة للأم أو للأب. هل أستطيع عمل طلب إغفال أو إعادة نظر أو طلب في الاستئناف أن تثبت الحضانة لي؟ طلبت توجيه اليمين لها وهو أحد طرق الإثبات وهذا طلب ضمني بالحضانة. وحتى لو رفضت المحكمة توجيه اليمين، كان المفروض أن تستكمل بإثبات الحضانة للأب لأن الأم طلبت فقط إثبات الطلاق بدون أي ذكر للحضانة. أنا والمدعية طلبنا الحضانة في المذكرات السابقة إلا أن المحكمة الابتدائية انصرفت فقط إلى المذكرات الختامية والتفت تمامًا عن الطلبات في المذكرات الشارحة والتعقيبية. ما فرص نجاح هذه المحاولة؟ وكيف أقوي من حظوظي في إثبات الحضانة في الاستئناف؟

How to claim money back from a client company if both our companies are closed?

Q: A company owes my company around AED 80,000. We filed a case and got a favorable judgment. We have filed for execution of judgment. However, it has been almost 2 years and we have not yet received the payment. The other company has stopped its operations but the Owner and Manager who is Emirati are still in Dubai. - Will I get my money if the other company has stopped operations? They have closed their office but they have not closed their license. - Unfortunately, I have to shut down my company. If I close the company, can I still encash a cheque received in the company`s name? Is there any way to inform the court that if money is received, I can receive it in my account instead of my company?

Q: Good morning attorney, Trust all is well. My husband`s employer ran away and didn`t give him his 3 months salary + 13 years gratuity. The company is closed now and none of the employees got even a single dirham from their employer. Some of them filed labor cases but till now, nothing happens.
