The employee is entitled to the repatriation costs only if he leaves the country

Q: I have a question about the repatriation ticket and costs. As per the Labor Law, the employee is entitled to an air ticket. But our company has put another line that I will get this benefit only if I leave the country and don`t stay in the UAE. Can this be enforced? "Repatriation Cargo Note: Please note that you will NOT be eligible for Repatriation Benefits, if you transfer your employment visa or if you shift jobs in the UAE or continue to stay in the country post cancellation of your employment visa. You need to secure approval on your repatriation cargo, and avail it within three (3) months from the last date of service. Repatriation Tickets The value of repatriation tickets which is 50% of your annual airfare for you will be added to your Final Settlement payment as per policy. Q: Hello, One of my non-Muslim friends had a minor accident while changing lanes inside the city and both the parties were fined and the issue was resolved. Then later he had a flat tire on the highway in Abu Dhabi. He called for the pick-up truck and as he was waiting for help and it was getting delayed for like 3 hours, he consumed one beer in the car and slept off. The police woke him up and took him to the detention center and kept him for 3 days. They took a fine of 20000 and left him. They said he will be notified and he has to appear in court. He is not sure what case is registered and how serious the issue is. What is the solution? Will he be able to get PCC later?

Can a husband force his wife to move out of the house upon filing a case for divorce?

Q: Dear sir/madam, I am under my company visa and not sponsored by my husband, however, now we live in an apartment that is under his name. He has filed for divorce in India and now suggests we should move to a shared apartment. Can he force me to move out of our current house? And can he force me to stay in a shared apartment? Q: Hello I was working between 2016 and 2020 in a company. The owners ran away without any notice during the Covid lockdown. Due to the lockdown, I couldn`t get a new job, so I decided to leave the UAE with my family. I have no intention to cheat anyone, but unfortunately, I could not pay any credit card dues until now. Now, I am working in business development so I need to travel to other countries as well. How can we check any travel ban, criminal case, and civil case? I can be ready to pay in installments one by one. The total amount is around AED 120,000 for 5 credit cards. One more question: In my new company, I need to visit various countries for work purposes at the time if I pay a fine in court/if no civil case against me. Can the employer terminate me during probation and force me to pay compensation?

Q: Hi. I have not gotten an answer to the same question. I joined a company more or less 4 months ago, and I have seen illegal manipulations happening to the staff. I am thinking of resigning. Now, I wanted to ask about “Article 4 (Additional Terms)” in the MOHRE contract, stating if I terminate the contract within 1 year, I have to pay 3x of my salary plus a ban of 1 year. And I am not allowed to work in any competing company for 1 year. Is this valid? The 2nd question, the company had forced me to sign the MOHRE contract without a probation period (I didn’t know they could even remove it), which was also stated in my company offer letter that I will have 6 months. An ex employee is suing me in labor court after renewing his visa to help him

Q: I have an LLC company. An ex-employee - with me for 12 years - is suing me in labor court. I told all my employees to leave in March 2020 when all events were canceled due to Covid as there was no money to sustain the business. He said he doesn`t want to go back to Iraq with his wife and kids, so we agreed that he would do freelance work if any came in. In April 2021, he finally agreed to return to Iraq but kept stalling and then begged me in June to renew his visa - he said then they would feel safe if any trouble happened in Iraq to be able to return. I renewed his visa as a kind gesture to help him and he never returned to Iraq. Instead, he went to the labor dept at the end of December 2021 and claimed unpaid salaries for a year. The paperwork is not in my favor as it was not until the end of 2021 that I realized he was playing a game with me. Can I apply for liquidation as the owner of the LLC Economic Dept. license? I do not have the huge funds to pay what he is claiming.
