Q: Dear sir/madam, Why is there a 2.5% court fee on appeal? Also if I appeal within 3 days, do I have to pay this extra? Can I open the case in 3 days and then submit the additional documents in 30 days? Can I also change the amount to below 100,000 in the appeal?

Gratuity calculation after 5 years of service

Q: Good day, I worked for a semi-government organization for a total of 5 years. I left the company in May this year. Upon leaving, I received 120k (approximately) as gratuity. In each of the 5 years, my salary was stated as AED65k in the 1-year contracts I had with the company. There was no breakdown of my salary, allowances, etc. In my last contract, 2021 to 2022, a new clause appeared stating that only 40 % of the AED65k would be a gratuity. Q: Hello, I would like to ask if I am legally obliged to pay for damage to a unit I rented that I did not commit. My family rented a unit in Abu Dhabi for 3 years. After a week of moving in, I found damage in the toilet that was already patched and fixed. I reported it to the landlord through email to notify them that it is an existing issue. It was not discovered during the move-in inspection due to its inconspicuous location. The landlord did not address the issue back then so I thought that this matter is settled. I was surprised that after moving out, I was made to pay for the damage and the huge amount would be deducted from my security deposit. I told the landlord that this was already a reported and existing issue but they did not relent. This was not noticed by their inspection team during move-out and was not even included in the report I signed. I pointed this out later to the team so that they could address this before a new tenant moves in. Thank you so much.

The agent wants money for absconding removal. What to do?

Q: Dear sir/madam, I came here with a tourist visa and I have overstayed. The office which did the tourist visa for me put absconding on me. I went to immigration for absconding removal and they directed me to go to the agent who did the tourist visa for me. When I went, he asked me to pay 4300 AED before he can issue a paper for me to immigration to remove my abscond. I want to know what can I do. Immigration has told me that the absconding fee is 541 AED.

س: السلام عليكم، لي أخ يعمل طبيبًا وكان يعمل بمركز طبي واستقال وانتقل لمكان آخر ولكنه لم يأخذ أوراقه؛ أي شهاداته ويمكن القول أن كلها صور ولكن بينها "شهادة تدريب مهمة" وما أخذه من الأوراق شهادة خبرة. رفضت جهة العمل السابقة تسليمه شهادة التدريب وراسلها لمرات عبر البريد الإلكتروني طالبًا الشهادة ولم يُستجاب لطلبه. أوصى بعض زملائه للتوسط للحصول على الشهادة وأيضًا تم الرفض، فما العمل؟ قد تسألون لمَ ترفض جهة العمل إعطاءه شهادته، والسبب أنه عندما التحق أخي بالعمل تم الاتفاق على إعطاء نسبة من الدخل، ورأت جهة العمل المبلغ الذي سيحصل عليه أخي كبيرًا فبدأت تماطل واضطر أخي للاستقالة وأُعطي تقريبًا ثلث ما يستحقه من النسبة والتي تبقت في ذمة جهة العمل. أخي لا يرغب أبدًا في الذهاب للمحاكم ولا يفكر في هذا الأسلوب، فبمَ تنصحون للحصول على الشهادة؟ وهل يطالب ببقية مستحقاته؟ علمًا بأنه وقّع وتم إلغاء ترخيصه من الجهة المشكو بحقها. وشكرًا والسلام عليكم!

تعذر رفع دعوى ضد مستأجر بسبب غياب بعض الوثائق

س: السلام عليكم، أحاول رفع دعوى ابتدائية ضد مستأجر سابق خرج من الشقة وخلّف وراءه أعطالاً ولم ينظف الشقة كما ورد في العقد. عندما وصلت لمرحلة طلبات الدعوى وأدخلت مطالبة مالية بسبب صيانة محددة القيمة، برزت رسالة في الأعلى تقول "رجاء تسجيل أمر أداء حيث أن الطلبات المقدمة تخص أمر الأداء فقط". عندما حاولت رفع الدعوى على أساس أمر أداء، طلب مني النظام تقديم وثائق غير موجودة حسب عقد الإيجار؛ مثلاً تعهد بالدفع أو ما شابه. كيف أحل هذه المشكلة؟ وتحت أي صفة يجب رفع مثل تلك الدعوى؟
