Evicting an employee from school accommodation while a labor case is pending

Q: Dear Sir/Madam, I was wrongfully terminated by my school under Article 44 on March 20th, 2023. I have a case in the labor courts, and the first hearing is on April 4th, 2023. However, my employer is asking me to vacate the school accommodation. I asked the Ministry of Labor and the courts, and they informed me that the school cannot evict me until the case is resolved. Is this information correct? I am currently unemployed and have nowhere else to go until I find another job.

Can the landlord evict me from the apartment to sell then rent it for a higher price?

Q: Hello, I am a tenant in Dubai. Last year in June, I signed my first rental contract in Dubai. One bedroom 864 sqft for AED 65,000. Later this year in October, I got an eviction notice saying that I need to leave the apartment when the contract ends because the owner has the intent of selling the apartment. A few days back in March, I got a call from his agent saying that no one is interested in the apartment because the landlord wants a big price so if I want, I can renew the contract. The new price for me will be AED 76,000. I took some time to think and then called him back saying that as per RERA they cannot increase more than 5% which will be 68,250 but I am willing to pay 70,000 not to move out. A few hours after the call I got an email that they re-inform me that I have to leave in June because they want to sell the apartment. Is it legal to kick me out like that because they want a bigger price? What actions can I take if they rent it out again after I move out?

How to settle the credit card payments with the bank that demands a lot more?

Q: Hello, Some time ago I took a credit card with AED 15,000 credit limit. I ran into financial issues and the bank gave a cheque to the police and I paid the fine. Now I want to settle and close this with the bank. I spent AED 7,500 on the card and I already paid AED 25,000 to the bank because of late payment fees, interest, over-limit charges, etc. But the bank is demanding an additional AED 25,000. Does that mean by spending AED 7,500, I have to pay the bank AED 50,000??? Is this allowed by the bank because it seems very unfair? How can I resolve this issue?

Can I file an absconding case against an employee after canceling his visa and labor card?

Q: Good day! I have a query on employee cancellation. An employee is canceled, i.e. both his labor card and employment visa. Can the employer ask the employee to leave the country even if he has a pending labor case against the employer and a 90 days grace period to leave the country after the visa is canceled? Let me be once again clear here, both visa and labor card have been canceled because the case is already in the execution stage, the Ministry of Labor closed the case and canceled his card, after which the visa was canceled. I want the employee (actually now ex-employee) to leave the country. If he is reluctant about the same, can I file an absconding against him? Please advise. Thanks

A scammer took the money and did not deliver the items. What to do?

Q: Hello all, I am based in the UAE; however, I have been a victim of scammers recently and am facing much distress. I ordered some items like an iPhone, a laptop, AirPods, a Play Station, and smartwatches, and paid the whole payment upfront, but that scammer didn`t deliver anything to me. I lost almost 15,000 AED, and now I have opened a case against the scammer with Dubai Police. I transferred the payment through an exchange by domestic transfer inside the UAE via 10 transfers because the scammer kept citing the delay in delivery and asked for more and more money to deliver the order. I admire that I had enough stupidity to transfer the payment with almost blind faith in the scammer. I have all the WhatsApp conversations which happened between me and the scammer, and all the payment confirmation slips, and the Emirates ID of the scammer. My concern in writing this email is to get the money back from the scammer. Thanks!

What can I do if the landlord sent me a rent increase notice above the allowed limit?

Q: My landlord has given me a 20% increase notice 90+ days in advance. As per Dubai REST app, the permissible increase is 10%. I have reverted saying it is not as per decree 43 article 1 and 3 but there has been no response. Also, as per the earlier contract, there are some maintenance activities that the landlord should do but that are still pending. 1. Would the notice be null and void as the increase is beyond the permissible limit? And can I request the same rent as last year? 2. What should I respond to the notice as it is already 20 days since I received the notice? 3. What are my options? 4. How do I get the maintenance done? 5. Should I wait till the end of the current contract and negotiate after that or the landlord can get me evicted?

Is it advisable to take the bank offer of 50% discount to pay the full debt?

Q: I would like to know about my issue: The bank sent me an email for a cheque execution notification case, an arrest warrant is in process and a travel ban is active. I have a personal loan of AED 50,000, two days after receiving the email, the bank called for a 50% discount for them to stop the case but I have to pay the full amount, a one-time payment. Since I cannot source this amount, I requested if they can offer installments but they refused and said they will proceed. At the moment, I still haven`t received any sms or email from Dubai Courts. I am worried about the warrant. Please help. What should I do?
