الأسباب القانونية لحكم المحكمة برد الطعن

س: أمرت المحكمة برفض الطعن في قضية حقوق عامل، على أي أساس يتم رفض الطعن؟ وما هي الخطوة التي يجب أن أقدم على فعلها بعد رفض الطعن؟ كما رفض طلب إيقاف تنفيذ الحكم؟ هل أصبح الحكم مبرم ونافذ وليس هنالك أي طريقة أخرى للطعن في الحكم مرة أخرى؟ أرجو نصيحتي يا إخوان. جزاكم الله خيراً

س: السلام عليكم يوجد شخص لديه تعاملات تجارية مع شركة وأعطاهم شيك ضمان للبضاعة وكان الشيك يحمل توقيعه و القيمة فقط بدون كتابة المستفيد أو تاريخ الاستحقاق. وتوالت التعاملات بينهم وكان الحساب بينهما صفر حيث سدد كل ماعليه، وعندما طالبهم بالشيك تهربوا مراراً وتكراراً إلى أن فوجئ بالقبض عليه بتهمة شيك بدون رصيد. وفي المركز عندما عرضوا عليه الشيك كان مضافاً اسم شركة لم يتعامل معها أبداً وتم إضافة تاريخ الاستحقاق وفي البلاغ قالوا أن هدا الشيك مقابل تعاملات تجارية بينهم. ولكن المشتكى عليه لم يتعامل مع هده الشركة أبداً ولا يعرف كيف وصل الشيك إليهم أساساً. فهل من حل لهده المشكلة؟ وهل إثبات عدم وجود تعاملات مع الشركة المذكورة أو حتى أنه لا يعلم كيف وصل الشيك اليهم يفيده؟ الرجاء المساعدة

Filing cases to recover the amount of a bounced cheque

Q: Dear Mrs Khan, I have recently received a Post Dated Bank Cheque from one of my new clients, the cheque date is Thursday 19th Apr 2018. Today, I called this client to find out that they are not answering calls, and when I went to their office I found it closed and many of their suppliers in the corridors complaining about their Bank Cheques that were bounced back (rejected). The owner of this company seems to have already left the UAE and none of his employees is answering the phone. So most probably the bank cheque that they gave me (AED 57250) will bounce back Thursday. So I want to start taking action now. I sold them 10000 boxes of 15 Kg lemon, which they stored in a third-party cold storeroom in Dubai. I went and found that the lemon is still there. Please, could you tell me how can I legally get back my lemon as I`m 100% sure I will not be paid? Thanks in advance and please feel to ask should you need more details.

Removing a UAE ban after recovery from TB medical condition

Q: I have visa ban in the UAE due to TB during my medical fitness test. So, I Left the UAE one year before and now after treatment, I`m ok with the problem but I`m having TB scars. Is it possible to lift my ban and apply for a new visa? If possible, please guide me.

Claiming end of service benefits and delayed salaries upon resignation

Q: I worked for my previous company based in TECOM, Dubai (Free Zone) for 3 years, during which period we had a lot of salary delays and got accumulated over time. By the time I resigned, 4 months and around 3 weeks salary were pending along with my settlement amount. Usually, all the amount need to be settled before the visa gets cancelled. But they convinced me (verbally), since there is no cash with the company at the time, that they would pay my pending amount as and when the salary is processed for the rest of the company. For that, they gave me a signed letter mentioning the total amount that the company owes me; but since my departure, 2 salaries have been processed in the company and I am yet to receive any. I have been regularly following up with them by mail and have only received "wait" response so far. Does this amount to cheating from their end? What are my legal options? Note: The company has been sued before for similar cases regarding payments by ex-employees / suppliers.

Q: Hi, I am outside of the UAE. I had a previous case for a bounced cheque with a bank in Dubai, going in front of the judge I was ordered to pay a fine, which I did and the case was cleared and I left the UAE. I have applied for an online police clearance certificate but it was rejected, does this mean there is an open case or due to the old case?

Q: Dear Madam Nikhat, I have outstanding amounts for two different banks on credit card. I lived in the UAE for almost 5 years and when I lost my job, I came back to home country and attempted many times applying for a visit visa to go back to the UAE. Unfortunately, all my visit visa applications were rejected and I came to know from the immigration department that I have got some AL Aman ban. After coming back to my home country, being jobless with no financial support I have paid (with the help of my relatives) installments on my credit cards upto 7months.
