Q: Dear, I have been recently divorced in Abu Dhabi. My ex-wife converted to Islam in order to get a sharia divorce, though during our marriage she`s always been a Christian. She has gained custody of the children, I had guardianship. As I had no employment in the UAE, end of March, I had to return to Belgium. Since then she has blocked any contact with my 2 boys. This weekend, I found out she is pregnant and is living with her boyfriend and my children in our flat (we own it) in Abu Dhabi. On top of that, she has stolen most of my belongings (family souvenirs, all my photography equipment). I want to know what I could be doing, being in Belgium right now. I want to get my kids, I don`t want her to get away with being pregnant, unmarried (she made me suffer and accused me of many lies). Her law firm is Al Rowaad!

Termination of a limited contract for pending salaries

Q: Hi, Location: UAQ Company: Construction Company LLC Limited Contract duration: 2 years Completed: 1 year and 3 months My contract is limited, and I want to cancel it due to pending salaries. My employer discussed more salary with me, but on the labour contract wrote less salary and didn`t tell me anything. He just asked to put finger thumb. He transfers salary in UAE Exchange from the start and same salary we discussed. But now, he is creating an issue of pending salaries and insulting me if I ask about salary. I saw my contract when I faced this issue and shocked to see only 1500 AED salary and not any other amount on the limited contract. On the company contract, he mentioned the same salary as we discussed. Now I want to get my pending salaries and change my company and cancel my old employer visa and contract.

Q: Good day, Attorney I was called by our HR and said that they will not continue my contract and it will be finished within two months. They said they will just finish it and will not continue. Fake attestation stamp and a possible case check

Q: I went to MOFA back in 2017 to have my documents attested. I am confident because I did really graduate from the university but what I didn`t really do myself is the attestation of my documents. Since I was already in the UAE, I asked someone to have my documents get attested. To my surprise, the officer told me that I will have to go to jail because the UAE stamp was fake. God is good it was late in the afternoon and it was Ramadan, so they let me go and ask that I go to Abu Dhabi after the Ramadan holiday. I immediately flew out of the UAE before any possible case is filed. Now, my question is will I still be able to go back to the UAE as a tourist? I just want to travel and not to work again. Is it possible that MOFA has filed a case against me even if I wasn`t there and I was only holding a tourist visa during that time? How can I find out? How can I have the case lifted if there is? Can I have it lifted by submitting the authentic documents and while I am outside of the UAE?

Travel ban and arrest warrant check before returning to the UAE

Q: Good afternoon, I need a legal advice: I have an unsettled bank debt in the UAE. I have lost my job in 2017 and I was not able to pay my instalments. After discussing with the bank, the bank agreed not to initiate any legal action against my liabilities, in order to return to the UAE to search for a job. I got a police clearance certifying that I’m of good conduct. My question is : Does this clearance guarantee that there is no arrest warrant /travel ban against me? Note: it is mentioned on the clearance: "the department is not responsible for legal rights of others". What does it mean? Appreciate your response! Thank you!

Is it legal to terminate employment without reasons?

Q: Dear Sirs Does an employee have to agree with a termination notice letter if not proper reasons were given??? The contract only states: 12.1. Subject to the following, the company may terminate the employment by giving to the employees one month notice. 12.2. The company reserves the right, at its discretion, to terminate the employment immediately without giving the period of notice to above by paying the employee her basic salary in lieu of all part of her notice period as the case may be. Q: Dear Ahmed, Eid Mubarak! I lost my job two years back and I have been on a couple of visit visas without luck! Q: Hello A DIFC based company I work for hasn`t paid 5 months worth of salary, plus business travel expenses. The total so far is around AED 700K. In addition, if I leave the company, there will be the gratuity and pay-in-lieu of unused vacation. The company is offering me post-dated cheques (cheques are in the name of the company, the signer is the group president and one of the shareholders). I am trying to get cheques above AED 200K (because if the cheques bounce it is a criminal charge, right?) 1- What are the consequences for the company and the owner if the cheques bounce? Will the signer face prison and travel ban? 2- How do I raise a complaint about the bounced cheques? Which police department or government authority I need to go to? 3- If the signer says the company doesn`t have money to cover the cheque, because the company is not generating revenue or has many assets, then what happens? does he get away with it? Proposal to renew an expired limited contract with reduced salary

Q: Hello Atty, I am a Sales Executive here in the UAE and my second two-year contract from my current company has already expired. I need your help. My contract expired last June 3, 2018, and before that, I asked them about my renewal and they told me after Ramadan. Now, that I follow-up, They will renew my contract but they want to deduct my salary, which I am not willing to accept. We did not discuss any of these changes before my contract expires. If I am not going to accept this offer, what are the things that I am legally entitled to get from my previous company? Moreover, I still have pending commission since 2016 out of our "gentleman`s agreement". Every 2% of the paid invoices will be paid as my commission. Now that I am trying to get it, he told me that the amount is too big and he can`t give it to me. I was trying to get my commission since 2016 but he always has a reason to delay it. Is there any way for me to get it? I have proof/records that I am getting the commission. Thanks in advance
