Request to cancel visa three years after expiry without any action from employer

Q: Last week I complained to labour against my employer because it`s three years since my visa expired and not renewed or cancelled. Yesterday, labour called my employer and he requested one month to cancel my visa, can I work part time for another company this time? If I go to work, can the employer file a case against me? Please reply.

س: السلام عليكم، طلب مشورة من ذوي الاختصاص. لديّ شقة في مشروع عقاري، وحسب العقد المبرم أدفع ٤٥٪؜ من قيمة الشقة في أثناء البناء على تواريخ متفق عليها من قبل الطرفين و٥٥٪؜ عند الاستلام. ذُكر في العقد موعد الاستلام في شهر ١٢ من سنة ٢٠١٩، ولكنني دفعت ٢٥٪؜ فقط وأوقفت الدفع التالية في بداية ٢٠١٩ لأن المشروع كان متوقفًا تمامًا وبعدها جرت عدة اتصالات مع الشركة المذكورة حول سبب وقف العمل بالمشروع لأني لست مقيمًا في دبي والآن يطالبونني بسداد الأقساط المتفق عليها بقيمة (٢٠٪) مع غرامة لأنني أوقفت الأقساط بمبلغ ١٢٠ ألف درهم إماراتي. اتصلت بهم وبعثت عدة إيميلات ليحذفوا الغرامة وكان الجواب بالرفض بحجة التأخُّر في السداد. إذا كنت متأخرًا في السداد، فهم أيضًا متأخرون في تسليم المشروع وهو ما برروه بأن لديهم عذر في ذلك. طلبت منهم أيضًا دفع ٣٠٪؜ لغاية التسليم وبعد التسليم ٧٠٪؜ وأيضًا رفضوا. حاليًا ليس لديّ ثقة في هذا المطوِّر لأن تعاملهم ليس سلسًا مع العملاء. هل هناك طريقة لفسخ العقد واسترجاع أموالي التي دُفِعت لهم؟ أو، أضعف الإيمان، هل هناك تعويض بسبب تأخرهم؟ مع خالص شكري واحترامي!

Will you get arrested upon arriving to the UAE for an unresolved rental case?

Q: I just found out I have a rental case in Sharjah. In the flat where I stayed, I had canceled the water and electricity and got a clearance certificate but did not complete the closing process with the landlord. They automatically renewed the contract as per the old agreement and went legal. There is a judgment also from Sharjah court to pay 1-year rent of 28k and evacuate. 1. There are no pending cheques. Is this a criminal case or a civil case? 2. Will I have any issue when I land in Dubai on a visit visa?

How to file a case for defamation and ruining business reputation?

Q: Is there any legal action I can take against a person for spreading false hearsay stories publicly which are false and not even linked to his company & he never checks with me on the true facts? The background story: I have legal negotiations and proceedings going on with a company that signed a business deal (between companies) with my company registered outside the UAE. While all this is ongoing legally, I get to know that the employee of this company with whom I am legally negotiating the disputed contract separately has gone and spoken to my ex-employer`s CEO (as they are good friends) and they have started telling rumors and wrong facts in the market making everyone think that "I ran away with the money". This is ruining my reputation with friends and ex-colleagues with whom I worked for a decade and also in the industry I worked in generally in Dubai. What to do after doing all the execution procedures to obtain labor dues?

Q: Dear Sir/Madam, I have completed the execution stage of the labor case against my previous employer for not paying my settlements, leave salary and other allowances. The company license is blocked, request to arrest the manager was submitted and approved by the court 2 months back. But to date, I haven`t received any amount. The company is still working and they have projects running in Dubai. Kindly advise me on what to do next. The case was submitted in the year 2020 April and taken a long time.

Does the salary increase apply to pending leave salary from previous year?

Q: Dear Sir, I have a question about leave salary. I have completed 2 successful years in a company in Abu Dhabi, my salary was 5000 (Including Basic & Housing Allowance) in the first year and I got 1000 as an increment in the second year.
