Q: A Jafza employee is on probation and has not completed his notice period. He is asked to leave without completion of the probation period. The offer letter specifies that either party may leave on a single-day notice. To support the employee as per Jafza rules, will the employee qualify for any notice period pay + claim on leave credit? The employee will not have any job in hand, in this case, how does the Jafza law protect the employee?

What to do if the employer counts overtime as regular hours?

Q: Hi In Oman, under Oman Labor Law, my contract has the basic salary of 45 hours which is fine and in line with labor law, but there is a second line which states "Additional Hours". We work a 60 hour week so that second line "Additional Hours" is basically 15 hours. The issue is the hourly rate for the 45 hours is the same as the 15 hours no change or an added minimum of 25% to the overtime hours as stated in Articles 68 & 70 in the Oman Labor Law. I have requested the company to backdate and correct this but they are ignoring me, do I have a claim or are they correct with a fixed hourly rate for a 60-hour minimum working week? Q: Hello, We hosted a digital online event with a supplier and paid 50% advance and provided them with an invoice-based PO for their services. During the event, their hardware crashed and their CEO requested us to cancel the event and postpone it after 2 weeks. With no options during the event and disappointing used experience throughout the event, we had no choice but to take their recommendation. We canceled the original event and rescheduled for the new date they proposed. During the NEW date event, only 300 people participated instead of the 1800 registrations. س: أقامت زوجتي ضدي دعوى طلاق للضرر (قضية 1) ولم يثبُت الضرر. استأنفت زوجتي الحكم (قضية 2) وحكمت المحكمة بعدم ثبوت الضرر. لم تطعن زوجتي في حكم الاستئناف وأقامت دعوى طلاق للضرر جديدة (قضية 3) فيها نفس الاتهامات التي تم النظر فيها مسبقًا. عرضت المحكمة الأمر للحكمين وأوصى الحكمان بالتفريق بيننا بدون بدل. تم حجز القضية للحكم وفي يوم الحكم "قررت المحكمة إعادة الدعوى للمرافعة بعدما تبين أن الولد يبلغ من العمر15سنة؛ الأمر الذي يحتمل فيه أن يكون قد بلغ مبلغ الرجال ويستوجب سماع أقواله حول البلوغ واختياره الحاضن". لدي ابن عمره 15 عامًا (مقيم بالدولة) تخطى مرحلة البلوغ وابنة عمرها 17 عامًا (تدرس في الجامعة خارج الدولة وليس لها إقامة في الإمارات). أسئلتي: 1- في حالة اختيار الابن الإقامة مع أمه، هل ستمد المحكمة سن الحضانة؟ 2- هل ستُلزمني المحكمة بسكن للابن وأمه في الدولة (مع العلم أنني أفضل أن يقيم الابن معي)؟ 3- ما وضع الحضانة بالنسبة للابنة خارج الدولة (أمها مقيمة بالدولة)؟ 4- هل أستطيع اختيار إقامة الابن في بلدنا الأصلي؟ 5- إذا كان راتبي 18الف درهم شهريًا، فما مقدار النفقة وبدل السكن وبدل الخادمة المتوقَّع للأم والأبناء؟
