س: السلام عليكم، باعت والدتي شقة ملكي بتوكيل مني سارٍ ولكن بدون علمي أو موافقتي. أقام المشتري دعوى صحة توقيع في ٢٠١٨ باعت والدتي نفس الشقة لشخص آخر بدون علمي أيضًا في ٢٠١٩. أقام المشتري دعوى ضدها يطالبها بالتسليم، علمًا بأنني أنا الوحيدة التي تملك عقد مسجَّل في الشركة والشقة في حيازتي. ما حكم القانون في هذه الحالة؟

حقوق المطلقة التي لم يدخل بها زوجها

س: السلام عليكم، إذا أراد الزوج أن يطلق زوجته، مع العلم أنه لم يدخل بها منذ الزواج في شهر 11/2021 إلى الآن 02/2022 بسبب أن الزوجة تعتذر دائمًا لعدم رغبتها في ذلك، فماذا يترتب عليه من النفقات؟ وهل يترتب عليه نفقة المتعة؟ وهل يجب عليه أن يذكر في المحكمة أنه لم يدخل على زوجته خلال فترة زواجه في حالة الطلاق؟

التظلم من تنفيذ قرار إبعاد قضائي صادر عن دولة قطر في الإمارات

س: السلام عليكم ورحمه الله وبركاته في عام ٢٠١٦ تم الحكم علي فى دولة قطر فى قضية إقامة علاقة غير شرعية بالتراضي سنة مع إيقاف التنفيذ والإبعاد، وبالفعل تم تنفيذ الإبعاد. سافرت إلى الامارات وأعمل هناك منذ حوالي ٦ سنوات. الآن أوقفوني بمطار دبي وتمت المطالبة بإبعادي بناءً على حكم صادر من دولة قطر. ماهو الاجراء القانوني؟ وهل يسقط حكم الإبعاد بالتقادم فى دولة أخرى، علماً بأن دولة الإمارات ليست طرفاً فى المشكلة؟ وأنا أعمل بالإمارات بدون أي مشاكل وسافرت أكثر من مرة من وإلى الإمارات دون مشكلة. فما السبب الآن وماهو التصرف القانوني؟

Can the defendant in a bounced cheque case file an appeal after 6 months?

Q: Last year I had filed a civil case about a bounced cheque. The defendant was unresponsive to all notices issued via email, SMS and even newspaper. The full process was followed after which a favorable judgment was granted to the performance order and an arrest warrant issued. The defendant was finally arrested on a warrant which was related to a completely different case filed by someone else. The judge granted him 30 days to settle dues but also released him without, it seems, any guarantees for reporting back. Of course, he did not pay and is now seemingly free and can not be located. Now after 6 months the defendant has filed an appeal. My questions are: 1. Under the UAE law, isn’t the deadline for appeals supposed to be 15 days from judgment? 2. What could be the possible grounds to appeal a bounced cheque? 3. Is there any mechanism to have a warrant executed on priority - especially since the defendant did not fulfill the settlement commitments to the court?

I resigned properly but the old company holds my dues and visa cancellation

Q: Dear Sir / Madam, I am working in a Jebel Ali Free Zone company for the past 5.5 years. Now I got a better offer, so I resigned last month and served 30 days notice period then handed over all my responsibilities. I left there one week ago and still, the company didn`t cancel my visa and they hold my settlement. Without a cancellation document, I am not able to join the new company. Whenever I contact them they are saying different stories and keep my documents pending. Please advise what to do. Thanks, J.

كيف أضمن حقي عند شراء شقة من ورثة بينهم قاصر؟

س: السلام عليكم أشتري شقة حالياً من ورثة وفيهم قاصر ووالدته وصي عليه. سمعت أن لازم موافقة المجلس الحسبي وإلا عقد البيع لا يجوز، ويحق للقاصر لما يوصل سن ٢١ أن يسترد نصيبه أو يبطل العقد. لا أعرف ماذا أفعل وكيف أضمن حقي.
