Travelling to home country for an emergency while there is a pending labor case

Q: Dear sir/madam, If I have a Dubai labor court case against my company to get my pending dues, can I travel outside the UAE with an expired ID and expired visa? I have overstayed the grace period and my employer did not cancel my labor card and residency visa. The court hearing is going on and I am waiting for final judgment but now I have an emergency in my home country so please let me know the procedure for how I can travel to my country without cancellation.

How can the tenant make a settlement with the landlord for unpaid rent?

Q: Dear Sir, I haven`t paid rent to my landlord since Feb `21 till date. The contract expired on Nov `21. I have been staying since then without a contract. While my phone calls - were disconnected since Dec `21, I did not hear from the landlord via Whatsapp or e-mail as well. And I also did not contact him. Today the landlord came and said that the court people came 2 months ago, to check if I was there. However the building management say they never were asked by any people about my whereabouts. My landlord says he wants me to vacate within 2 days. Pending rent is for 13 months. 9 months of the contract period and four months of non-contract period. Today I paid him 25,000 and tomorrow we will draw up an agreement plan for the balance payment of AED 67,000. The landlord has AED 13,000 of my deposit with him. Can I request a 30 days eviction period from the landlord? As I have not gotten any formal notice as yet. I know i am still in the wrong. Please advise. Thank you

Is the termination after sending two warning letters an unfair dismissal?

Q: Good afternoon, I`m an employee with my company for 4 years with an unlimited contract. I have just renewed my visa last month but yesterday I received a termination letter from my company stating that based on my performance and 2 warning letters on the 6th of October and 21st of November. I received a warning letter on the 6th of October but I didn`t sign and replied with justification and on the 21st of November I didn`t receive any letter. Please advise, should I sign the letter, and can this be considered an unfair dismissal?

س: السلام عليكم، طلقت زوجتي (لا يوجد أطفال) طلاقًا رجعيا أوليًا بإرادتي المنفردة. نحن من سكان إمارة أبوظبي وانتهت عدتها. حُكم لها في محكمة أول درجة في أبوظبي بمؤخَّر الصداق ونفقة العدة ونفقة المتعة ورُفض طلبها بنفقة أجرة سكنى العدة على استقلال لشمول نفقة العدة المحكوم بها ضمن مشتملاتها على هذا الطلب، ورفض طلب بدل الضرر المادي والمعنوي. أتفهم الحكم وأنا على استعداد لدفعه، ولكنها استأنفت الحكم بمطالبة بزيادة النفقات والحكم لها بأجرة مسكن عدة وبدل الضرر. علمًا بأنها طوال فترة العدة كانت تسكن في منزل والدها بإرادتها ولم تطلب المجيء لمسكن الزوجية الذي استأجرته وكان ما زال مؤجرًا طوال فترة العدة. سؤالي: هل سيُحكَم لها بنفقة سكنى العدة لمدة ٣ أشهر مرة خاصة أنه لا يوجد أطفال وهي ليست حاملاً؟ وماذا عن طلب بدل الضرر؟ أرجو المساعدة بهذا الخصوص. وشكرًا!

Is it necessary to serve the whole notice period of a limited labor contract?

Q: Hi sir/madam, Recently, I joined a company as a digital marketing executive. Now it is 1 month over and my visa is in process & my status changed to e-visa. I am in a limited contract and have a 6 month probation period. But now I don`t want to continue here because I am getting different works. It is not based on my carrier and my position. So I would like to resign from this company. Based on my offer letter, there is a 3-month notice. Is it necessary to put 3 months` notice? Or is it possible to resign without notice? My visa is not stamped yet and my medical is not over. Do I get any labor ban? Please help me with this issue?

Can a company appeal against a judgment in the execution stage?

Q: Dear sir/madam, I filed a case against my company and the company does not attend the court hearing. I got a judgment from the count. After that, I went to Al Adeed center to collect the judgment and they asked me to register a request to claim it and come after one week. After one week, I went there and they said now you are eligible to file execution to get the money; you can come after 15 days. We will update the status. I want to know if there is any chance the company can go to appeal against this judgment? If they go, how long does it take to get money from the company?

An employer refuses to give an employee his labor dues after waiting for 6 months

Q: Dear sir/madam, I served my 2 months notice and resigned on the 12th of August as I was supposed to leave the country on the 14th of August during peak COVID time with my dependents. However, I had to ask for a 1-month extension which would be served with my annual leaves as during peak COVID times, the flights would get canceled without notice. My manager and the HR were kept in the loop and my HR sent me a work permit cancellation letter which I signed and submitted upon confirmation from my manager. Later when I enquired, my HR said that I am absconding and would receive my settlement after 6 months so I waited. Now after 6 months, on inquiry, HR calls my manager and asks him to inform me that I won`t be paid anything as I am absconding. Now my question is when I have kept everyone in the loop, my manager, the HR with all the steps, how can I be declared absconding. I have all the emails and chats as proof and would like to know where do I stand legally?
