How can I claim my money back from a travel agency for not fulfilling their obligation?

Q: Dear Legal Team, I have been scammed by a local travel agency based in Dubai. They offered me to pay in advance at the beginning of 2022 beginning for a cheaper tour package. But I was not able to travel in 2022. Eventually, they didn`t refund my money in 2022 and did not carry it forward in 2023. How can I take my money back?

س: السلام عليكم، لم يستطع المقاول إكمال الفيلا بالشكل النهائي قبل الاستلام المبدئي. بعد الاتفاق مع الاستشاري ليضمن إكمال الأعمال والتعهد بذلك، وافقت على إصدار شهادة الإنجاز. الاستشاري كان من البداية يسهل أمر المقاول حتى وصل الأمر إلى ترك الفيلا والعمل حسب الرغبة بدون متابعة الاستشاري. كيف أقدم شكوى ضد المقاول والاستشاري؟

س: مرحبًا إخواني، ارتجع لي شيك بمبلغ ١١ ألف درهم، علمًا بأن المستفيد قدَّمه بعد تاريخ الشيك بـ١٠ أيام. كان يتوفر رصيد كافي للصرف في تاريخ الشيك المقرر وأنا فعلاً نسيت الشيك ولكن قلّ الرصيد ورجع الشيك. تواصلت مع المستفيد لإخباره بإعادة صرف الشيك مجددًا فلم يرد وتجاهل الأمر. المبلغ متوفر بالحساب منذ شهر ويأبى أن يصرف الشيك. هناك خلاف سابق بيننا بصفتي مستأجرًا لعقاره بقضية وقد كسبتها مسبقًا. قام بتوجيه إنذار لي من المحكمة للسداد خلال ٣٠ يومًا. تواصلت معه وأيضًا لا يرد. ماذا يمكنه أن يفعل ضدي في هذه الحالة والمبلغ متوفر بالحساب؟ وهل هناك حبس أو تعميم؟ علمًا بأنني أحاول الوفاء له.

Landlord's threat to accept unfair rent increase or face eviction

Q: Dear Lawyers, I have been a tenant for the past three years and my landlord has been arguing about the rent. I have always stated that I will pay whatever is required according to RERA. Last year, in January 2022, he gave me a court-attested notice to sell the property. Throughout the year, he has been threatening to evict me and not renew my contract if I do not agree to his demands of an 80% rent increase. He has only had one viewing in the last 12 months (and has not listed the property on any websites) just to show that he is attempting to sell it. He has openly stated that he is willing to allow me to stay if I accept the 80% increase in rent, but if not, he will ask me to leave (and refuses to put this offer in writing). He claims that he has enough evidence to show that he tried to sell the property, and after I leave, he will leave it empty for two months before renting it out again, and there is nothing I can do about it. Can I dispute this in RDC and get my contract renewed? If I leave and he rents the property out after three months, can I claim damages from him?

Does the gift stand as a sale in its legal effects for a property transfer?

Q: Dear Sir, I served a 12-month notice to my tenant in Dubai to vacate my apartment through the Court (Notary Pubic) in March 2022 because I wanted to sell the apartment. I have not been able to sell the apartment because I did not get any suitable offers to date. Now my son has offered to buy the apartment from me, so I would like to transfer the title deed to him by way of a `gift` because it is more cost-effective. Will the gift of the apartment to my son count as a sale without any restrictions? I am not a resident of Dubai. As per my understanding, the gift will count as a sale, because the ownership will change and a new Title Deed will be issued in my son`s name by the Dubai Land Department. I would like to get this opinion in writing for my records.

Is it legal for the landlord to ask for a rent higher than the RERA index?

Q: I am a tenant and for the last 3 years, my landlord has been arguing about the rent. I always say I will pay as per RERA. Last year in Jan 2022, he gave a court-attested notice to sell. All year he has been threatening to throw me out and not to renew if I don`t agree to his demands of an 80% rent increase. He has only done 1 viewing in the last 12 months (the property is not listed on any website). He is willing to let me stay if I accept an 80% increase in rent, otherwise, he is asking me to leave (refuses to give this offer in writing). He is saying he has enough evidence to show he tried to sell and after I leave he will keep empty for 2 months and then rent it out. I have emails from past years. During this year, I have had some WhatsApp messages but he is refusing to give the actual renewal offer in writing. If he gives me a drafted Ejari physically & gets my signature first before signing himself, will I still be able to take it as evidence to RDC? Or will the RDC say I have agreed to the new terms by signing the new Ejari?
