How can we prevent blocking accounts and assets in a cheque execution case against our company?

Q: Greetings!! We have a cheque execution case. The bank applied for execution to block the company account and the vehicles claiming the wrong amount. The court also approved this request and sent it to the central bank to impound the vehicle. We had already paid over 50% of the claimed amount and also requested the balance payment in installments a couple of weeks ago once the claimed amount was amended in the court system. The installment request is yet to be approved, however, they have proceeded with the execution. This is very concerning. How long does it take to block the accounts? What are the repercussions of the block? Kindly please advise if there are any other options available to avoid blocking the accounts and impounding the vehicle. Thank you

What to do if the Offer & Deposit application has been rejected twice by the landlord to increase rent?

Q: Dear Lawyers, I filed 2 Offer & Deposit applications: 1. Notice & Rent Increase: The landlord gave a 90-day notice to an unregistered email that is not listed in the tenancy agreement. My Jan 2025 filing, based on the Dec 2024 RERA Index, showed no rent increase, but the landlord now claims a 5% increase per the updated RERA Calculator this year. 2. Rental Payment: To deposit/transfer rent. Both were rejected due to the landlord’s nonresponse. However, the first installment was transferred via RDC & I provided the receipt. The landlord now demands the remaining payments, a renewed Ejari, & AED 420 admin fee (vs. the usual AED 265). They also threatened with eviction since Ejari expired last month. I’ve offered to provide PDC or deposit the amount. They have asked me to follow up with RDC to ensure the 1st payment is transferred to their account. Since I completed the Offer & Deposit process, I prefer they initiate a preliminary case. Could you please advise on the best course of action at this stage?

Q: Hello, My friend took a loan of 100,000 Dirhams from a finance company in the UAE and repaid almost half through installments. However, after losing his job, he was unable to continue payments. The finance company then deposited his guarantee cheque, which bounced. This happened three years ago. Recently, the finance company has engaged a debt recovery agency in Pakistan to recover the remaining amount. My question is: Does the debt recovery agency in Pakistan have the legal authority to force my friend to repay the debt?

We applied for a mortgage and signed Form F but failed to secure it due to job loss. What can we do?

Q: This was my initial question: My brother and I applied for a mortgage loan for a property from a bank and we signed Form F with the real estate agency back in March 2024. However, during this process, we both lost our jobs, and thus the mortgage wasn’t approved and Form F expired. We also informed the real estate agency of such circumstances as to why we won’t be moving ahead. Yesterday, we were both along with the real estate agency given a legal notice to pay the 10% deposit which was contracted in Form F. However, this already expired and the real estate agency has gone missing along with the agents we were dealing with. The owner says the same that he wasn’t informed about it and will continue with the case.  Now even after our reply to the legal notice, the owner has filed a lawsuit and there is now a court date online. What would be the best way to proceed and how can we make this lawsuit go away? It is causing us a lot of stress.

Q: Hello, Are landlords allowed to increase rent for residential property at the first annual renewal? My landlord is asking for a 10% increase. My contract renews on June 20, 2025, and the 90-day notice period ends on March 19, 2025. At present, the RERA index shows no increase for my apartment. They have also included the following language in their email requesting the rent increase: "Please be further advised that your rent will be reviewed and revised, subject to applicable laws and any amendments to regulations by the Dubai Rent Committee." 1. Are they allowed to increase rent after the first anniversary of the lease? 2. If the index currently shows no increase, on what basis are they asking for a 10% increase, and what does the language in quotation marks allow them to do?
