Claiming the passport of an employee from the old employer
Q: I want to hire a young lady, but her previous employer is holding her passport. They are requesting her to provide an entry visa from the new employer (me). An entry visa is when she exits the country, correct? She will not have to exit if she can get her passport for me to process her new resident visa, correct? Her old employer is based in Abu Dhabi and they state this is how Abu Dhabi does things. I am confused because they shouldn`t be holding her passport first of all, and they shouldn`t have an entry visa to release her passport. Please advise.

Resignation for the non-payment of salaries and claiming entitlements
Q: I have been working in a free zone company in Dubai for 14 months and I did not get my salary for more than 8 months. Every time I was asking for the salary, the employer tells me that he did not get payment from clients and he is still saying like that. Now, I sent the resignation letter due to the non-payment of salary, but the employer told me that I cannot resign and I need to finish my 3-year contract otherwise he will deduct the amount from my salary. I don`t want to work for this company and also I have a good offer from another company. So, do I need to work for the employers? Will I get a ban?

Recovering the amount of a bounced cheque in Iran
Q: Dear Sirs, I loaned my colleague at work an amount of money and he gave a cheque in return. This amount was never returned, and I was embarrassed to ask him every now and then until I understood he never intended to return it. Necessary precautions before issuing a replacement of a lost cheque
Q: Hi, I live in Abu Dhabi. My landlord lost one of the rental cheques. I have a receipt and a Tawtheeq of when I handed them over to him. I told him to go to the police and file a lost report and then I can issue a new cheque to him but he states that this will take too much time. He suggests that he gives me a paper saying that if they find the cheque they will return it to me and to give them a new cheque. Please note that it`s a company managing my landlord`s properties.

Proof of innocence in an embezzlement case
Q: My brother in law is in jail for taking AED 12 million from his company and he is in jail (Abu Dhabi, UAE) under remand. I don`t know whether he had taken the money or not, but his employer is saying he had taken it and given him a confession letter. I don`t know about the confession they took. I had not seen him because it happened last week and I am not able to go and meet him as it is very far from my house and also I have no blood relation. I need to take permit from the prosecution department. I trying to meet him by next week. Kindly advise me what I need to do. Also, advise me on: 1. Suppose the above thing has happened, how many years he needs to be in jail? 2. If it is a false case by the employer, how will we prove his innocence? 3. Will the court give a chance to him to prove he is innocent and how? Please note that he has no advocate. 4. Q: Dear Sir, I need an advice on my three rental cheques of AED 4800 each, which bounced in Sharjah and the landlord has filed a complaint in Sharjah Police Station.
