Maternity leave and related rights under the UAE labour law

Q: Hello. I need to know my right. I was on my maternity leave and I took an additional 1-month leave along with my maternity before leaving so I can be with my little one for more time. However, I got pain and infection in my stitches as it was my second c-section. I took a doctor leave and sent it to my company for an additional 2 weeks` leave extension, but they refused. So I told them it`s not possible for me to work at the moment hence consider it my resignation. Now, they are not paying my gratuity and end of service benefits and trying to deduct one-month salary as I didn`t serve my notice. I`m concerned because I never had intentions to resign and requested for leave. They left me no choice even I sent a proof to them the doctor`s documents as support. They shouldn`t deduct one-month salary as notice because it`s not my fault. Can anybody help? Moreover, the time they don`t pay or deduct I want to go legal way to challenge them. Is it possible?? Help me, please.

س: أنا طبيبة أسنان متخصصة في جراحة الفم. قمت بزرع أسنان لمريض سعودي بالعيادة، ظناً منه أن الزرع سيكون بشركة معينة وأنا استخدمت شركة زرع أخرى. فلم يتم الزرع ولم يتم عمل الإشعاع للمتابعة، وتوجه لطبيب آخر أخذ منه تقرير طبي أن الزرعات بها مشكلة ولابد من التغيير. و فعلاً قام بنزعها بعد رفع محضر في القسم، مع العلم أن محامي السفارة السعودية هو من دعمه في ذلك. الآن ما الواجب فعله؟ المحضر إداري وهو لم يسدد قيمة المبلغ في العيادة وادعى في المحضر أنه دفع مبلغ مالي أكثر من المتفق عليه.

Recovery of cheque amount from debtor as per an agreement

Q: Hello Sir, One person had given me a cheque of AED 154000 and we made an agreement for this cheque. He was supposed to pay the whole amount before Nov 2018, but until now he paid only AED 29000. Now, he says he wants that cheque of AED 154000, and in return, he will give another new cheque deducting the amount of 29000. But the agreement says upon receiving the complete payment of AED 154000, the cheque will be returned. We agreed and signed he is threatening he will not pay any money. I want to ask, can we bounce this cheque and file a case against him? Can we directly put a travel ban on him after his bounced cheque? Please explain.

Forcing the new owner to undertake pre existing liabilities of the company

Q: Dear all, I have a bit of a complicated situation and need your help, please. 4 months ago I had transferred my DMCC registered company fully to another individual with all of its liabilities. The company had a loan with the bank for which I gave my own cheque so I can secure the loan amount and the new owner agreed to take this loan as part of the company liability. DMCC says the loan is the liability of the company and the new owner responsibility. The bank says that the new owner needs to come and change the signature from mine to his - until then it is my responsibility. The new owner doesn`t want to do it now that the company is transferred to him and therefore the bank keeps on charging me the loan instalments. Can you please advise on what to do in this situation and what choices do I have? Many thanks

Q: I took a personal loan from a bank in Dubai, 130000 total. Now, my pending is 99300. I lost my job and now I got another job but salary much less, so some dues came. Q: Hi Mr Muhyealdeen, I was hoping you could answer a quick question for me. If I have an open legal case against me raised by a bank for unpaid liability, then the liability is paid off, are they obliged to close that legal case and/or issue a NOC? The reason I ask is that my bank won`t close it as I have another outstanding liability and in negotiations to settle, they can only open a civil case for that one, not a legal one. So my question is, are they legally allowed to keep a case open for a liability that`s been paid off? Can they be forced to close it? Thanks

س: السلام عليكم. أنا كنت أعمل مضيفة في الاتحاد للطيران بمدينة أبو ظبي. أخذت قرض والدفعة المتبقية هي 150000 درهم تقريباً. دفعتني الضرورة لأن أستقيل عبر الإيميل فقط وليس رسمياً. كان يجب أن أدفع 5000 درهم للاتحاد للطيران للاستقالة دون إعلامهم ولم أدفعها، ولم أدفع 10000 درهم إيجار سيارة كنت استأجرتها. عدت لبلدي للضرورة في عام 2017 وحتى اليوم لا أدري أي قضايا علي ولا ما حصل. البنك الذي يتواصل معي على الإيميل يهدد بفتح قضية. حصلت الآن على عرض عمل في قطر بمبلغ 15000 درهم شهرياً، و لا أدري ما الحل.

Medical negligence and its remedies in Dubai

Q: Dental malpractice: My daughter had a root canal done by a specialist pediatric dentist at a major hospital in Dubai and final reports and doctor claimed it was completed. After that, the final payment was made and we were given a form for an insurance claim that everything was completed. However, after going to another establishment, X-rays showed the root canal was not completed and the child is required to go through the whole procedure again causing mental agony and pain. My child is not willing to go to any dentist much alone the same dentist because of the traumatic events and pain she endured of the 1st root canal which was supposedly done over 3 sittings. I contacted the 1st hospital and they agreed in writing that it was a mistake. The doctor also has called me personally to apologize and he would carry out the procedure including additional services free of cost. My child is 3 years old and traumatized and unwilling to go to any dentist. What are my options to claim?

Cancellation of SEWA connection from outside the UAE

Q: I had lost my job in the month of Oct 2018 and went out of the UAE after the cancellation of my visa, but I didn`t cancel my SEWA connection because I paid complete one year rent to house owner and my brother was there with me.
