The consequences of resignation in a limited labour contract

Q: Dear Sir, I hope you are doing well. My neighbour brother went earlier to Dubai for packing work in a hotel for 2 months. Due to the condition of work & not getting a proper salary, he decided to resign from his job. When he intimated the same to the employer they said he should pay AED 4500 before leaving & his own ticket. He is from a very poor background that`s why he came for AED 900 salary. But he gets actually 750 only without food. Need your kind support to help him to come back to India.

س: السلام عليكم لدي استفسار عن الفصل التعسفي في حال عدم تجديد العقد. لدينا موظف يعمل بوظيفة محاسب من شهر 8-2017. في 24-12-2018 تقدم بطلب للحصول على إجازة لمدة 5 أيام. لم تتم الموافقة عليها وتمت الموافقة على إعطائه إجازة ليوم واحد لكنه تغيب عن العمل لمدة ثلاثة أيام، وفي اليوم الثالث تواصل معه صاحب العمل وأعطاه مهلة شهر للبحث عن عمل آخر. طلبت منه السكرتيرة الحضور لمكان العمل لإتمام الاجراءات وقبض مستحقاته (المبلغ المتبقي من راتبه + راتب شهر الانذار + بدل الإجازات المتبقية). لكنه رفض وطلب أن يتم دفع رواتب الأشهر المتبقية لغاية شهر 8-2019 بحجة أن العقد يتجدد تلقائياً بعد انتهائه في 8-2018 وهدد أنه سيرفع شكوى في المحكمة. السؤال، هل يتجدد العقد تلقائياً مع أنه غير مذكور في العقد موضوع التجديد التلقائي؟ وما هي المستحقات التي يحق له الحصول عليها إذا رفع شكوى؟ ولكم جزيل الشكر

س: السلام عليكم أريد بيع شقة تمليك إرث، وسألني المشتري عن حصة الأرض فوجدت في العقد هذا البند: "البند الرابع - يقر الطرف الأول بأن الملكية للشقة موضوع البيع قد آلت إليه بطريق الشراء بموجب عقد البيع الابتدائي المؤرخ في ..... من المالك الأصلي للأرض .... الذي آلت إليه الملكية بطريق الشراء من السيدة .... بحسب العقد المسجل برقم .... استبدال من وزارة الأوقاف. وبالنسبة لإقامة المباني بطريق ترخيص المباني الصادر له من مراقبة التصميم بحي شرق الاسكندرية ". فهل يعني هذا وجود حصة مشاع على الارض؟

Arbitrary dismissal and compensation under the UAE Labor Law

Q: Dear Madam, My name is R. S. working as a facilities maintenance supervisor in Shariah, UAE. My employer terminated my unlimited contract with one-month notice period (Arbitrary Dismissal) and provided me with all benefits with notice period payment of one-month full salary. I requested the company to pay compensation salary for an additional 3 months with my yearly bonus of 1.5 months salary. The company did not agree and I filed a formal complaint at MOL online, but the mater is not solved yet and MOL transferred my case to the court. Kindly advise what is the actual benefits I have to get as per the UAE employment labour law. Still, I am requesting at least to pay compensation of 2 months` salary and they are not ready to pay. Is it advisable to solve my issue at the court? If not, please advise what is my right and further step.

Q: Dear Sir, Would like to know how I can deal with the following situation. I am the MD of a granite exporting firm in Andra Pradesh, India. In Sep 2018 I had delivered two containers of granite to a company in Ras Al Khaimah. The understanding was AED 10K on the delivery of container and the remaining 35K within 3 months as PDC. However, the client gave only 5K as cash on delivery and so far has been giving various excuses (in between around 45 days he was in India). The PDC date was in Dec 2018. My company is not registered in the UAE and we have delivered the container on CNF. The cheque issued is on my name and is from the client`s company. I need to know what I should do to recover the money. I have a residence visa in the UAE. Thanks Sajan

س: يوجد أحكام غيابية من محكمة الجنح الابتدائية في مصر ضد متهم مصري هارب إلى الأردن مجموعها يتجاوز 10 سنوات حبس بالإضافة إلى كفالات في قضايا شيكات بدون رصيد. فقد استولى على ملايين الجنيهات من المصريين وهرب. منها حكم (3 سنوات وكفالة) قام بالمعارضة ولم يحضر باقي الأحكام (سنة حبس وكفالة إلى 3 شهور) وهو مقيم في الأردن مع زوجته الأردنية وله محلات في الأردن ولكنها باسم زوجته. عنوانه معروف ويسافر إلى تركيا لشراء بضاعة لمحلاته ويشتري بضاعة لمحلاته من مصر من خلال مندوبين لكنه لا يسافر إلى مصر. تم إبلاغ الانتربول بالأحكام وبعنوانه وقد أبلغنا الانتربول منذ 4 أشهر أنه تم القبض عليه عند عودته من مطار أنقرة إلى مطار عمان بالأردن وطلب من الأردن ترحيله لمصر. ولكن تم الإفراج عنه ولم يفصح الانتربول عن سبب عدم ترحيله حتى الآن رغم كثرة سفره ومعرفه عنوانه في الأردن. السؤال/ هل يمكن عمل إجراء في الأردن مثل إصدار أمر بتنفيذ الأحكام من النيابة في الأردن؟ أو إعلانه أو تبليغه بالأحكام في الأردن ليقوم بالمعارضة والاستئناف ثم الوصول للحكم النهائي و القبض عليه أو إقامة دعوى لتنفيذ حكم أجنبي في الأردن أو حل آخر؟

Getting clearance from the bank after settlement of a loan

Q: Hi Miss Gatina, I was hoping you could answer a quick question for me. If I have an open legal case raised against me by a bank for unpaid liability, then the liability is paid off, are they obliged to close that legal case and/or issue a NOC? The reason I ask is that my bank won`t close it as I have another outstanding liability and in negotiations to settle, they can only open a civil case for that one, not a legal one. So my question is, are they allowed legally to keep a case open for a liability that`s been paid off? Can they be forced to close it? Thanks Debs
