Q: Hi, I am currently working in India. I have accepted a job offer from a company in Dubai. I have also signed and shared the MoL offer letter. While I am serving notice period in India I have received another offer from Dubai. Can I reject and accept the other offer? What are the legal implications around this step? Regards, A. S.

Q: Hi, Could you please let me know what is the rule for cheque return that we give for our loan guarantee? We took a loan one year ago for AED 770,000 and now we can not pay the instalments. Our cheque is AED 1,200,000 and the bank deposited the cheque. They said they will open a case in Sharjah, and we don`t know the cheque return rules in Sharjah. My husband is out of the country now and he wants to come back, but we`re afraid if they open the case in Sharjah as we heard that they keep the person in jail until returning the full amount. Our loan was 4 years and the instalment was AED 25000. We paid 8 instalments. Now, the cheque returned and we don`t know whether they`ve opened a case or no and if they opened what we should do. Please advise me if it`s better for my husband not to come back to the UAE or to Sharjah. Also, will they fine him around AED 20000 without jail or they will keep him in jail. Thanks and regards

The legal way of recovering the amount of bounced cheque

Q: I got a cheque of AED 220k which bounced. I opened a case with Sharjah police. They contacted the gentleman and his brother told me they detained him this weekend at the police station. It seems tomorrow a court appeal will happen. I have not been contacted by the police or the person who gave me the bounced cheque. The proposal according to his brother would be 14 cheques of AED 10k and two cheques of AED 35k (Total 16 months). If the person leaves the country, will I have issues for the cheques? If I leave the country to relocate somewhere else, do I have any issue to get my money? If in the 8months a cheque of AED 10k bounced, what will be the consequences? Thank you for your kind help.

تنازل المشتكي في شكوى الاحتيال لا يسقط الحق العام فيها

س: السلام عليكم، شكر الله لكم جهدكم العظيم والذي تبذلونه في خدمة وتوجيه وإرشاد الناس. أساتذتنا الكرام: أنا أردني مقيم خارج الأردن وتم تقديم شكايتين ماليتين من طرفين ضدي في المركز الأمني نفسه في الأردن. تم تعميم طلب تنفيذي ضدي، وبعد التواصل مع المشتكيين وتسديد ما كنت مدان به ذهب الطرفان لإسقاط الشكاية في المركز الأمني وكف الطلب التنفيذي . لكن تم رفض طلبهما من قبل الشرطة بحجة أن شكايتهما ضدي صنفوها احتيال!! (( وهي ديون ). أنا الآن مقيم في دولة أخرى وانتهى جواز سفري ولا تجدده لي السفارة بسبب طلب التنفيذ القضائي وانتهت اقامتي وتم إخراج أبنائي من المدارس وتم توقيفي من العمل بسبب انتهاء إقامتي. كيف لي أن أحل هذا الأمر دون الذهاب إلى الأردن؟ وهل يحق للشرطة رفض التنازل من المشتكيين بحجة أن شكايتهما ضدي تصنف احتيال؟ أفيدوني جزاكم الله خير الجزاء.
