Settlement in a bounced cheques case and removing jail sentence

Q: A friend of mine has a few criminal cases in Dubai for bounced cheques. The complainants of his bounced cheques are individuals. Criminal cases have been filed and a sentence of jail term has been imposed by the Dubai Court in Absentia. He would like to know the following: 1) If he reaches the settlement with the complainant, can the jail term be removed? 2) In some instances, if the complainant is not in Dubai anymore, then how can the settlement be reached in order for the jail term to be removed? Please advise. Thank you.

Termination of employee without following the COVID-19 regulations

Q: Hi, An employer has terminated an employee during the recent COVID-19 crisis. However, didn`t mention any reason on the termination letter. The employee was paid only 1-month notice pay instead of 3 months. The company also didn`t follow any of the 5 measures advised by the government but instead went to terminate the employee straight away. Can this be taken legally?

Employee rights in case of salary reduction due to COVID-19

Q: Ramadan Kareem! I am working in retail with an unlimited contract. Last March, my income has been reduced by 20% due to the company`s internal restructuring. Unfortunately, the COVID-19 pandemic got even worse forcing me to be in furlough. They have reduced my income by 80% until 3 months. At the same time, the company had asked to donate some of the Annual Leave days to help the company during the crisis. Is this legal? The company is going to put me into redundancy soon and they have advised that it will be only for a month instead of the 3-month compensation. Kindly advise.

س: كنت مديرًا وشريكًا بشركة ذات مسؤولية محدودة، وبحكم وظيفتي بصفتي مديرًا للشركة، وقَّعت شيك ضمان لأحد العملاء بمعاملة تجارية باستخدام دفتر شيكات الشركة، وبعد عامين تركت وظيفتي وانسحبت من الشركة وسلَّمتها لمدير وشريك آخر. حدثت بعد هذا التاريخ خلافات تجارية بين الشركة من ناحية وبين العميل من ناحية أخرى فرفع العميل دعوى مدنية ضدي وضد الشركة. ما موقفي وحجتي القانونية في هذه المشكلة مع العلم أن قيمة الشيك مُثبتَة بالعقد ومُعرَّفة على أنها شيك ضمان وليس وفاء؟ شكرًا لحضراتكم!

Terminating an employee's contract without notice and offering a reduced EoSB

Q: My company is registered under Tecom media city. They terminated me without proper notice and are asking me to agree on end of service benefits based on a reduced salary. I have never signed any contract for a reduced salary. They also asked to sign a form in which it is written that all dues are cleared and they will pay me money over 9 months of equal installments. What should I do as I am in financial trouble? It`s difficult to hire a full-time lawyer and stay without money in the UAE. labour entitlements in case of termination for redundancy

Q: I am writing this mail to clarify my redundancy termination and end benefits. I had been working with a construction and maintenance LLC from the period of 01-09-2015 to 15-04-2020. I have received a termination letter on 15-04-2020, the reason mentioned is due to redundancy. Working hours reduction during Ramadan

Q: Hi. We`re working for 10 hours on regular days, with 30 minutes break. Our schedule for normal days is 10:30 am - 2:00 pm and we`ll come back at 5:00 pm - 10:30 pm. For Ramadan, it`s still the same - 10 hours. Our employer issued a working schedule of 11 am - 9 pm with a break of around 30 minutes in it. Is this legal? If not, what can we do with this? Thanks, N

The rights of an employee upon finishing a limited contract without renewal

Q: Dear Sir, I finished my 2-year limited contract. My visa grace period is going to be finished also soon. My company is still not paying my gratuity. They say that, for a limited contract, there is no gratuity! They paid me a part of my leave salary; I received full leave salary on my first vacation but they still not providing my air ticket. 1. Is gratuity applicable for a 2-year limited contract? 2. Compensation for terminating the limited contract by the employer

Q: My husband was working on a limited contract. The company informed him that he is terminated because they no longer need his services. He completed 1 year in March 30th 2020. The company informed him that his contract is renewed until Dec 2020 and he worked until April 30th 2020. On April 30th 2020 they sacked him. They asked him to serve notice period until May 30th 2020. Is he obliged to serve the notice period and what are the entitlements that he can claim? Please advise.
