مسؤولية الموظف عند إصدار وكالة خاصة له لإدارة الشركة أثناء سفر المدير

س: السلام عليكم، أنا موظَّف بشركة ذات مسؤولية محدودة ولست شريكًا ولا مديرًا. قام المدير بعمل وكالة خاصة لي لإدارة الشركة أثناء سفره خارج البلاد. مَن المسؤول قضائيًا أمام المحاكم في حال واجهت الشركة قضايا مدنية؟ هل أنا مسؤول؟ وفي حال لم أكن مسؤولاً، هل يمكنني الحضور أمام المحكمة بدلاً منه دون محاسبتي شخصيًا؟

Refund of the broker's fee in case of no agreement with the landlord

Q: On 20th April, we paid 5% agency fee and 5% landlord deposit for a new property rental contract, ready to move in on the 1st May. A week after the 20th April, we contacted the agent and landlord to request to urgently pull out of the agreement due to husband losing his job. We lost the 5% deposit to the landlord as he insisted on cashing our cheque. However, are we entitled to ask for the 5% agency fee back as we didn`t even move into the new property? We have tried to contact the agent but he is not communicating with us.

Housing allowance obligation of a terminated employee during COVID-19

Q: Under the Ministerial Resolution 279 of 2020, are the employers required to pay all allowances (housing, transportation, insurance) except for wages for employees that they terminate? If so, for how long will they have to pay for this? Until they cancel their visa, 30 days after cancellation of visa, as long as they are in the UAE or until the end of 2020? What if the employee does not leave the UAE, but gets an investor visa within the 30 days of cancellation, will the Employer still be liable to pay allowances once the employee gets the investor visa since the employee has not left the UAE?

How to cancel visa and take another offer if the employer refuses

Q: I got a job offer from another company and resigned from my current company, giving a notice period of 30 days. The employer refused to accept my resignation and stated that they will not be cancelling my visa due to COVID-19 issues since they cannot hire anyone else (This is just an excuse they are making). Failing to pay off-plan property instalments and terminating SPA

Q: I have booked a unit under construction with a developer 3 years ago. I paid 30% during construction and 70% was due since Jan this year. When I booked the unit, my plan was to get financing from a bank to cover 70% payment because I was working with a semi-government company. But I lost my job and my credit score went low due to defaulting on financing payments and I could not get financing from the bank. I have contacted the developer asking them for refund or change of payment plan but they give me instalment plan for 5 years and increased the price which I cannot go for. I am not in a stable situation with my current job and the company gave me 3 months unpaid leave because of Coronavirus situation. The developer completed 100% construction and they sent me a building completion certificate in Jan this year and now they are calculating 3% late payment fee every month as per SPA. Now I do not have any source of income. Can I get refund from developer so I can cover my expenses?

Terminating a property contract when the unit is not registered with Oqood

Q: I have not received my Oqood registration document from my developer after making the 4% fee payment on Aug 18. What are my options? Can I pull out of the contract? I have the signed SPA from the developer and all payments are up to date with receipts/invoices to prove. I am based in the UK so showing my documents is difficult. Q: Hello, I agreed with my wife to divorce by mutual consent. We have a son and a daughter (12 years old and 8 years old). We agreed that custody would go to the mother. My salary is 35,000 AED. I will pay the agreed-upon deferred dowry and will cover the house rent, education, and medical care for my children. What other expenses am I obligated to cover, and approximately how much are they? Is there an alimony of mut`aa (consolatory gift given by the husband to the wife upon divorce) in case of mutual consent divorce? What is its approximate value? (Given that I will cover housing, education, and medical care, with the total housing and education expenses amounting to 10,000 dirhams per month, and they have comprehensive health insurance), how much do I need to add to this?
