Q: Sir, Hope all is well with you. We hired this office to represent our case against ABC Company and we won it. We are XYZ Company. The money that we won was sent to Mr R.`s account. Unfortunately, he passed away. My question is, how can we get our money? Many thanks

Q: T&Cs for employment contract period: six (6) month from the date of arrival in Saudi Arabia/extendable. Note: as per the nature of turnaround/shutdown projects, in the event of immediate termination by the employer before contract expiry, 1-month basic salary shall be provided. My arrival date: 27-02-2020. Released from the site: 16-04-2020. What benefits I can get as I have not been deported by the company to my destination country where the contract started?

س: السلام عليكم أخي المحامي، لو تكرمت مستأجر محل تجاري في الرياض وكانت بداية العقد الجديد 01/06/1441. مر شهر ونصف تقريبًا وأُقِرَّ الحظر وتعطلت نهائيًا عن العمل. تواصلت مع صاحب العقار لإنهاء العقد لأنني لا أستطيع أن أدفع، ولكنه لا يتجاوب ويريد إيجار السنة كاملة رغم الظروف. ما الحل في هذا؟ ما الخطوات التي أستطيع اتباعها بعد الخسارة التي تكبدتها؟ وشكرًا!

Rights of the employee in termination with reduced notice period

Q: My company gave me a termination letter dated 19/4/2020 but the letter issue date was 6/4/2020. The company mentioned in the letter that my contract finishes in 5/5/2020. I just received the letter, signed and mentioned the date. According to my receiving date, I received the termination notice only 15 days. I already talked to the manager and he admits. What is the penalty for my company? I am in Jeddah, KSA.

احتفاظ شركة تمويل بسيارة مرهونة رغم سدا د الثمن بالكامل

س: شركة للتمويل قامت بسحب السيارة بناءً على قرار محكمة التنفيذ بمكة المكرمة وتم السداد عن طريق المحكمة وتم رفع قرار التنفيذ من قبل المحكمة. لكن الشركة لا زالت تحتفظ بالسيارة ورفضت تسليمها لي إلا بعد دفع الأقساط مع العلم أن هذه الأقساط تمت وهي محجوزة لديهم وليست معي. السيارة تم شرائها بنظام التأجير المنتهي بالتمليك هل لهم الحق في استمرار حجز السيارة رغم أنه تم تنفيذ قرار المحكمه والسداد لدى المحكمة؟ كانت حجة شركة التمويل أن المبلغ لم يصلهم من المحكمة بعد وأنهم يطالبوني بسداد المبلغ كاملاً مع الاقساط الجديدة، وفي حال وصول المبلغ من المحكمة يتم إرجاعه عن طريق صندوق الشركة.

مستحقات العامل عن الإخطار المتأخر بعدم تجديد عقد محدد المدة

س: تم إخطاري بعدم تجديد العقد قبل انتهاء العقد ب 12 يوم علمآ أن عقدي محدد. رفض صاحب العمل صرف راتب شهرَي الإنذار أو مكافأة إنهاء الخدمات، وأخذ جميع مستحقاتي كونه عليه مديونية عن قرض باسم الشركة. هل أستحق الشهرين عن إنهاء الخدمات؟ هل يحق له أن يخصم جميع مستحقاتي؟ هل أعتبر العقد مجدداً ويحق لي أن أطالب برواتب سنة كاملة؟ أرجو الرد

Termination of a property SPA due to COVID-19 situation

Q: I have made a 20% down-payment against an off-plan property in 2017. The sale & purchase agreement does not include a "Termination/Refund" clause and the property is due for handover by the end of the month. The property value has dropped by 40% and I`m able to only get a mortgage for 80% of the current value. However, due to the current situation and the impact of COVID-19 financially, I`m not in a position to proceed with the remaining instalments. I have to forfeit the contract as the developer has not given me any options for deferral of payment and has declined the request for a delayed handover. Please advise if and how I can get a refund on the 20% amount that has already been paid upfront.
