The consequences of getting pregnant before marriage

Q: Hi, Good day, Madame/Sir! My inquiry is related to my pregnancy before marriage. I am 5 months pregnant and I got married last month, May 2021 here in Dubai. I would like to know if I would have trouble. Can I give birth to my child here? And register the birth too? Any advice we can do to avoid legal issues? Kindly advise. Thanks in advance!

رفع دعوى لندب خبير مصرفي لحساب المديونية على حقيقتها

س: عملت تسوية مع أحد البنوك بالإمارات بخصوص كريدت كارد. السداد بفائدة عالية على 3 سنوات. المشكلة أني أسدد بعد معاد الاستحقاق والبنك يضيف فائدة إضافية وغرامة تأخير شهريًا. المبلغ المتبقي مرتفع وباقي 6 أشهر بسب فوائد التأخير وتنتهي مدة الـ3 سنوات. هل يمكن رفع دعوى لندب خبير حسابي لمعرفة المبالغ التي سددتها خلال 3 سنوات ومعرفة المتبقي؟

A landlord wants to arrange viewings to sell the property while the tenant refuses

Q: I have just renewed my lease, and now the landlord informed me that she wants to sell the villa and wants her agent to arrange viewings. What are the procedures and requirements to change a local service agent?

Q: I am 100% owner of Dubai mainland company under professional license. The company was established at the end of March 2021 and the setup process was run by a local service agent. However, I am not satisfied with the local agent`s service quality and I`d like to get your advice about changing the local agent. Here are my questions : - Is it OK to change the local agent? - What are the procedures, cost and time needed to make a change? - Do I need to physically be in Dubai for the change? - It has been only 3 months since the establishment but the service fee was paid for 12 months. Am I eligible to get the refund If I end the contract earlier than the agreed timeline? - What is the approximate cost for changing? Thanks.

Possibility to refund property down payments for handover delay

Q: I bought 2 off-plan properties in Dubai, a 2-bedroom in one project and a 3-bedroom in another. I paid the Oqood and the 10% downpayment and then due to no financial liquidity, did not pay the payment plan which is 40% up to construction and 60% thereon. I explained the situation to the developer via email and in-person meetings and I asked them to refund 50% of what I paid or consolidate both properties to make it easier. Many other options are given but they did not cooperate for over 3 years. The projects were delayed in delivery/handover. One was delivered later than committed and the other had to be delivered by 30-dec-2020 but even that till Jan 2021 was 68% done. I have my life savings stuck in this horror deal since 2017 august and want to get out with something in my hand. What can be done?

س: فترة إخطار الفصل من العمل في عقد غير محدد المدة. لقد استلمت خطاب بالفصل من الشركة بتاريخ ١/٤/٢٠٢١ وكانت صيغة الخطاب بهذا الشكل: "This is to inform you that your employment with the company is terminated with immediate effect from 01 April 2021. This is in line with the management team`s review of our business needs; the job role you are currently performing has been made redundant. You are directed to hand over all company property so that the final settlement of dues have been cleared in accordance with the UAE labor laws subject to the satisfactory completion of the handover process." علي حسب فهمي للخطاب أن الفصل تم بصورة فورية لذلك توقفت عن العمل لحين الغاء الإقامة واستلامي مكافاءة نهاية الخدمة علماً بأن بطاقة العمل انتهت في تاريخ ١٨/٤/٢٠٢١ والإقامة انتهت في تاريخ ٢٩/٥/٢٠٢١. الآن الشركة تقول أنه سوف يتم خصم مبلغ شهر الإخطار من المكافأة، علماً بأنه لم يتم توضيحه في خطاب الفصل. سؤالي هو هل من حق الشركة أن تخصم المبلغ من مكافاة نهاية الخدمة؟ سؤال آخر، هل سبب الفصل الموضح في خطاب الشركة يعتبر فصل تعسفي؟

Paying compensation in lieu of the notice period of an unlimited contract

Q: I am an auditor employed by my current employer on an employment contract of unlimited duration. I have completed 3 years and 10 months of employment. Recently, I received a job offer from another company and I am eager to take it up. I resigned from the employment with my current employer and served them a notice period of 30 days and agreed to pay in lieu of another 30 days as my employment contract states 60 days` notice period if any of the parties intends to terminate it. My current employer accepted my resignation but has asked me to comply with the 60-day notice period mentioned in my employment contract. Can my current employer restrain me from leaving the employment prior to the completion of 60 days notice period?

Forcing an employee to serve 6 months notice period

Q: I have been working in Dubai as a manager in the facilities management industry for the last 16 years. Now I got a government job in the UAE and I submitted my resignation with one month notice period. My employer refused to accept my resignation and asked me to provide 6 months notice period. My residence visa will expire 65 days from the date of my resignation. I convinced my new employer to wait until my visa expiry. My current employer threatens me that he will file a case against me to delay my cancelation to stop joining a new company. Kindly advise what I can do in this situation!

س: السلام عليكم ورحمة الله وبركاته، وصلني إيميل من شركة لخدمات النفط والغاز وطلبوا مني إرسال سيرة ذاتية مُحدَّثة واسمي والراتب المتوقَّع. قالوا أنهم وجدوا سيرتي الذاتية بموقع عبر الإنترنت وبعدها بيومين أرسلوا موافقة وأرسلوا عرض وظيفي وطلبوا مني تخليص إجراءاتي مع شركة سياحية لخدمات الجوازات ودفع المبلغ الذي سسيُرد لي. تواصل معي شخص وطلب مني تحويل مبلغ لاسم شخص عن طريق الويسترن وسألتهم لماذا لا يكون باسم الشركة فردوا أن الضرائب مرتفعة وأنا الآن أنتظر حسب قولهم خلال يومين ليصدر work permit لأنني سعودي من دول GCC. أنا الآن قلق لأن أحد الإخوة أخبرني أنها نصب واحتيال؛ علمًا بأن الإيميلات باسم الشركات المذكورة أعلاه وعرض العمل به أختام الوزارت الإماراتية.

Can you claim compensation from the developer for delay in handover?

Q: Dear I have paid 100% of my property payments and it was confirmed by the developer that they will hand over the apartment in the month of April 2021 but still, they haven`t handed the apartment over. When I called them today, they told me it will take another one more month but they are not giving a tentative date. Now we are paying the mortgage loan and monthly rental payment. I am now getting struggle for paying both the loan and monthly rental. Can I claim compensation if the developer delay further?
